April 6, 2005

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 6, 2005, at 6:55 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairman Grebien, Councilors Barry, Bray, Carr, Clemente, Hodge, Moran, Vitali and Wildenhain.

 

Absent – 0.

 

Chairman Grebien presides.

 

The reading of the records of March 23, 2005, is dispensed with and the records are approved as prepared by the Clerk.

 

Communication from Carl Salvo, Jr., to Pawtucket Board of License Commissioners.  (Objection to the transfer of Class A PLW-MA, Inc., d/b/a Douglas Wine & Spirits (Pawtucket), transfer from Gary’s Liquors, Inc., 1179 Central Avenue, 727 East Avenue and  CLASS B (Victualer)  Rob Yaffe d/b/a Garden Grille, 727 East Avenue is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILOR MORAN.

 

Upon motion made by Councilor Moran, seconded by Councilor Bray, the following application is WITHDRAWN WITHOUT PREJUDICE on a unanimous voice vote:

 

CLASS A

 

PLW-MA, Inc., d/b/a Douglas Wine & Spirits (Pawtucket), (transfer from Gary’s Liquors, Inc., 1179 Central Avenue) 727 East Avenue, LIC#10342

 

The matter of a FORMAL HEARING regarding the following license is taken up:

 

CLASS A

 

 Murphy’s Liquors Inc., 290 Pawtucket Avenue, LIC#10022

 

Representing the City of Pawtucket is Margaret M. Lynch-Gadaleta, City Solicitor.

 

Ms. Lynch-Gadaleta states that the license holder has agreed to accept a plea of nolo contrdre and to a fine of $500.00.

 

THE CHAIR RECOGNIZES COUNCILOR MORAN.

                       

Upon motion made by Councilor Moran, seconded by Councilor Bray, the License holder HAS ACCEPTED A PLEA OF NOLO CONTENDRE, AND SHALL PAY A $500.00 FINE, FOR THE FOLLOWING REASONS:

 

SELLING INTOXICATING BEVERAGES TO AN UNDERAGE PERSON ON THE LICENSE PREMISES (RIGL 3-8-1), ON OR ABOUT DECEMBER 31, 2004.

 

FAILURE TO MAINTAIN CONTROL OF PATRONS AND/OR EMPOLYEES, AGENTS, ENDANGERING THE HEALTH, SAFETY AND WELFARE OF THE GENERAL PUBLIC.

 

Communication from George L. Kelley, III, Chief of Police, to Pawtucket City Council Board of License Commissioners, regarding Howard Rogers Post, 25 McCallum Avenue is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.

 

With majority consent of the Council, the following motion made by Councilor Clemente, seconded by Councilor Moran, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to issue a Summons to Howard Rogers Post, 25 McCallum Avenue, Pawtucket, RI, to appear at a FORMAL HEARING on Wednesday, April 20, 2005, for the following reasons:

 

OPERATING AFTER HOURS (RULE #24 – LIQUOR CONTROL ADMINISTRATION)

FAILURE TO MAINTAIN CONTROL OF PATRONS AND/OR EMPLOYEES, AGENTS, ENDANGERING THE HEALTH, SAFETY AND WELFARE OF THE GENERAL PUBLIC.

 

THE FOLLOWING LICENSES ARE APPROVED ON A UNANIMOUS VOICE VOTE:

 

Class F  (Full Privilege)

 

Petition of Cape Verdean American Development Community, to sell alcoholic beverages at Fund Raiser Dinner/Dance, at 120 High Street, on Saturday, April 16, 2005, from 9:00 p.m. to 1:00 a.m. LIC#144

 

Petition of the Pawtucket Foundation, to sell alcoholic beverages at Fundraiser, at Hasbro, Inc., 1027 Newport Avenue, on Thursday April 7, 2005 from 5:30 p.m. to 9:00 p.m., LIC#145

 

Upon motion made by Councilor Moran, seconded by Councilor Hodge, the meeting is adjourned at 7:00 p.m.
