Pawtucket Board of License Commissioners
August 6, 2003
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, August 6, 2003, at 6:55 p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Barry, Councilors Bray, Carr, Clemente, Grebien, Hodge, Moran and Wildenhain.
Absent – Councilor Hoyas.
Chairman Barry presides.
The reading of the records of July 23, 2003, is dispensed with and the records are approved as prepared by the Clerk.
A public hearing is held on the following application for license, which was advertised for a hearing at this time, is taken up:
CLASS B (Victualer)
Solo Atn Inc., d/b/a Pilon Bar & Grill, (Transfer from Deb’s Place Inc) 617 Prospect St. LIC#10318
PREVIOUS STIPULATIONS
Doors kept closed at all times.
No entertainment shall be allowed.
Speaking in favor is Laura DaSilva, 223 Warrington Street, Providence, RI, applicant.
Ms. DaSilva states that she is in the process of buying the property, contingent upon the approval of this liquor license.
Upon questioning by President Barry, Ms. DaSilva states that she has some experience in office work for her husband. She states that she wants to operate a bar & grille business and would want an entertainment license. Her hours of operation would be what the city and state laws allow. There is a large parking area across the street encompassing approximately 12,000 sq. ft., which is being sold with the building.
Councilor Wildenhain states that he has observed large 18-wheeler trucks parked in this lot.
Ms. DaSilva states that they would have to move. She states that her family is investing a lot of family money into this business and they want to improve the area.
She states that her cousin, Joe, will operate the business on a daily basis. She states that he has 10 years of experience running a bar business. The latest place is a place called the Mirage in Providence.
President Barry asks if this business is near the YMCA in Providence?
Ms. DaSilva answers yes.
Speaking in opposition is Ervin Kmiec, 35 Raymond Avenue, Pawtucket, RI.
Ms. Kmiec states that he has lived in this neighborhood for 77 years. He states that there have been 4-5 establishments at this location. All these businesses start off nice and then they deteriorate. Problems include litter, loud music, noise, etc., and he does not feel he should have to put up with this type of business.
Speaking in opposition is Wanda Hyde, 45 Fortin Avenue, Pawtucket, RI.
Ms. Hyde states that she lives next door to the parking lot and has lived there for 42 years. She states that during the previous ownership, there were problems in the parking lot consisting of sex, drugs, noise, litter, etc. She states she does not want noise or entertainment again.
There are no other speakers.
The hearing is closed.
President Barry states that no one ever contacted the district councilor regarding this transfer. In this case it is President Barry. Also, if the sale is contingent upon the approval of the liquor license, the applicant should be aware that there will never be an entertainment license at this location. Further, the applicant must meet with the neighbors, and if applicant can agree to no entertainment, this matter will be considered.
THE CHAIR RECOGNIZES COUNCILOR BRAY.
Upon motion by Councilor Bray, on behalf of President Barry, seconded by Councilor Wildenhain, the following license is LAID ON THE TABLE on a unanimous voice vote.

Schedule a neighborhood meeting.
Submit job experience of person managing the business, listing all places of employment.

With majority consent of the Council, Councilor Bray introduces the following communications:
Communication from Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the transfer of Class B (Victualer) liquor license of Deb’s Place, Inc., 617 Prospect Street to Solo Atn, Inc., in the amount of $1,065.00.
Upon motion made by Councilor Bray, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

Mr. Imad states that he has worked with his cousin (current owner) for the past 11 years and is now buying the business from him, and is asking the Council for approval.

With majority consent of the Council, upon motion made by Councilor Wildenhain, seconded by Councilor Grebien, the following license is APPROVED on a unanimous voice vote:

Toti’s Pizza Palace, Inc., (Transfer from Toti’s Pizza and Restaurant Inc.) 622 Central Ave. LIC#10319
Communication from Lester & Maria Mombelly, owners of the Heritage Tap, 266 Grand Avenue, to the Board of License Commissioners, requesting permission to seat customers outside, with 3 tables on the sidewalk and 4 tables on the lawn, is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
With majority consent of the Council, the following motion made by Councilor Wildenhain, seconded by Councilor Grebien, is PASSED on a unanimous voice vote:
Request from Lester & Maria Mombelly, owners of the Heritage Tap, 266 Grand Avenue, for permission to seat customers outside, with 3 tables on the sidewalk and 4 tables on the lawn is APPROVED.
