October 9, 2002

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, October 9, 2002, at seven nine o’clock p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairman Barry, Councilors Bray, Carr, Clemente, Grebien, Hodge, Hoyas, Moran, and Wildenhain.

 

Absent – 0.

 

Chairman Barry presides.

 

The reading of the records of September 25, 2002, is dispensed with and the records are approved as prepared by the Clerk.

 

Claim of Arcaro, Belilove, and Kolodney, objecting to the transfer of Class BV liquor license of Eugenio Gibau & Belarmino Darosa d/b/a Malibu Bar & Grille, 602 Smithfield Avenue, to Malibu Bar & Grill, Inc. d/b/a Malibu Bar & Grill in the amount of $9,252.00, is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILOR BRAY.

 

With majority consent of the Council, Councilor Bray introduces the following communication:

 

Communication from Arcaro, Belilove, and Kolodney, releasing their objection to the transfer of Class BV liquor license of Eugenio Gibau & Belarmino Darosa d/b/a Malibu Bar & Grille, 602 Smithfield Avenue, to Malibu Bar & Grill, Inc. d/b/a Malibu Bar & Grill in the amount of $9,252.00.

 

Upon motion made by Councilor Bray, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

Claim of McLaughlin & Moran - Budweiser, objecting to the transfer of Class BV liquor license of Eugenio Gibau & Belarmino Darosa d/b/a Malibu Bar & Grille, 602 Smithfield Avenue, to Malibu Bar & Grill, Inc. d/b/a Malibu Bar & Grill in the amount of $748.55.

 

Upon motion made by Councilor Bray, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

A public hearing is held on the following application for license advertised for this time:

Previous Stipulations:

GRANTED AT THE MEETING HELD 10/10/01    

1.  Entertainment allowed 1 day per week on either Fridays or Saturdays.

NEW STIPULATIONS ADDED AT THE MEETING HELD 12/19/01

2.  Detail police officers on Friday and Saturday evenings.

3.  Back doors are to be kept closed at all times.

 

Speaking in favor is Eugenio Gibau, applicant.

 

Mr. Gibau states that the owners of this business are incorporating.

 

Mr. Gibau states that this business has been under his management for the past year.  He is continuing to improve the appearance of this business and is transforming it from a club to a restaurant. 

 

Mr. Gibau requests that the Council give him a second chance by removing the stipulation that a detail officer is required for Friday and Saturday evenings.

 

Mr. Gibau states that there has not been an incident at this business since last December.  He further states that he is spending about $14,000 a year for these detail officers. 

 

Councilor Clemente states that he will not remove any stipulations at this time based on the report received from the police department listing a number of calls to this establishment in the past year.

 

There are no other speakers.

Upon motion made by Councilor Clemente, seconded by Councilor Grebien, the following application for license is APPROVED PENDING THE SETTLEMENT OF ALL OUTSTANDING CLAIMS AND WITH ALL STIPULATIONS TO REMAIN IN PLACE on a unanimous voice vote:

Malibu Bar & Grill, Inc. d/b/a Malibu Bar & Grill (Transfer from Eugenio Gibau & Belarimo Darosa d/b/a Malibu Bar & Grille) 602 Smithfield Avenue, LIC# 10311

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.

 

With majority consent of the Council, the following motion made by Councilor Wildenhain, on behalf of Council President Barry, seconded by Councilor Clemente, is PASSED on a unanimous voice vote:

 

The Clerk is instructed to schedule a FORMAL HEARING on the following license, based on the recommendation of the Police Department.

 

Caribbean Entertainment Inc., d/b/a Cosmopolitan Club, 25 Roosevelt Ave. LIC#10269

 

Upon motion made by Councilor Bray, seconded by Councilor Hodge, the meeting is adjourned at seven twenty-five o’clock p.m.
