A regular session of the Pawtucket Board of License Commissioners is held Wednesday, May 9, 2001, at seven thirty-three o’clock p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Barry, Councilors Bray, Carr, Hodge, Hoyas, Moran, and Wildenhain.
Absent – Councilors Clemente, and Grebien.
Chairman Barry presides.
The reading of the records of April 25, 2001, is dispensed with and the records are APPROVED as prepared by the Clerk.
COUNCILOR GREBIEN ARRIVES AT SEVEN THIRTY-FIVE O’CLOCK P.M.
A Public hearing is held on the following application for license advertised for this time:
CLASS B (Victualer)
Jimmy’s Bar & Grill Inc., (Transfer from R & N Pubs Inc., d/b/a Caster’s Pub) 605 Broadway, LIC# 10290
STIPULATIONS
1. Stoplight in rear of building shall be repaired and turned on at all times.
Present at the hearing are the following:
Anthony Rossi, Attorney, representing the Applicant
James Tsafonias, 114 Doyle Avenue, Providence RI., Applicant
Attorney Rossi states that the applicant agrees to the previous stipulation and also states that Mr. Tsafonias will improve the building both inside and outside.
Mr. Tsafonias states that he has experience in this type of business and operates a pizza restaurant on 114 Douglas Avenue, Providence RI.
Mr. Tsafonias states that the restaurant will not be operating for 2 to 3 weeks so that he can renovate the building to operate the same operation as his Providence business.
In response to President Barry, Mr. Tsafonias states that he will be at the site operating the business. In addition to himself he will have six to seven employees who will be TIPS certified.
Anthony Rossi states that the applicant intends to renovate and operate the kitchen.
There are no other speakers.

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
Upon motion made by Councilor Wildenhain, seconded by Councilor Hoyas, the following license is APPROVED with previous STIPULATION to remain in place, on a unanimous voice vote:

STIPULATIONS

Present at the hearing are the following:

Greg Murphy, 14 Nicholas Drive, Cumberland RI, Applicant
Applicants state that they will be serving lunch and dinner from 10:00 a.m. to 10:00 p.m. Sunday through Thursday, and Friday and Saturday until 11:00 p.m.
The menu will include fresh seafood, fresh salads, etc. They would like to serve beer and wine, as well as specialty drinks. There will be no bar at this establishment.
Applicants have previous experience and operated a restaurant on Cape Cod, Massachusetts for 5 years.
Applicants state that they would like to serve liquor with lunch and until closing. All employees will be 18 years old or older and will be TIPS certified.
Speaking in opposition is John Scolaro, 244 Newport Avenue, Pawtucket RI.
Mr. Scolaro is concerned with the lights in front of this business shining in his house. The lights were covered at one time, and is requesting that they be covered up again.
Mr. Murphy states that the awning which covered the lights is being repaired, and he was unaware of the problem; but will make sure that this is taken care of.

Upon motion made by Councilor Hoyas, seconded by Councilor Carr, the following license is APPROVED with the following STIPULATION on a unanimous voice vote.

Representing the applicant is Christopher Heberg, 97 Cottage Street, Pawtucket, RI.
Also present at the hearing is Stenographer Sandra Bachini Gaboriault.
THE DETAIL TESTIMONY OF THIS HEARING IS FILED IN THE VAULT OF THE CITY CLERKS OFFICE.
Attorney Frank J. Milos, states that the license holder is present and has agreed to the following:
1. FINE OF $500.00, PAYABLE IN 30 DAYS.
2. A FOUR DAY SUSPENSION FOR THE DAYS OF FRIDAY, MAY 11, 2001, SATURDAY, MAY 12, 2001, SUNDAY, MAY 13, 2001, MONDAY, MAY 14, 2001.
3. EVIDENCE THAT ALL BARTENDERS ARE TIPS CERTIFIED.
4. A DETAIL POLICE OFFICER SHALL BE HIRED ON FRIDAY AND SATURDAYS BETWEEN THE HOURS OF 9:30 P.M. AND 1:30 A.M.
Attorney Heberg states that client is in agreement with these conditions.

With majority consent of the Council, the following motion made by Councilor Clemente, seconded by Councilor Wildenhain, is PASSED on a unanimous voice vote:
The following is imposed on the Class BV Liquor License of The Sports Zone Inc., d/b/a Pit Bar & Grille, 602 Smithfield Avenue, Pawtucket, RI. LIC#10263 for the following reasons:
Incident at Club on April 29, 2001
Continuing Neighborhood Disturbances
Failure to maintain control of patrons and/or employees, agents, endangering the health, safety and welfare of the general public.
1. FINE OF $500.00, PAYABLE IN 30 DAYS.
