Pawtucket Board of License Commissioners
July 11, 2001
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, July 11, 2001, at seven forty-two o’clock p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Barry, Councilors Bray, Carr, Hodge, Hoyas, Moran, and Wildenhain.
Absent – Councilor Clemente, and Grebien.
Chairman Barry presides.
The reading of the records of June 20, 2001, is dispensed with and the records are APPROVED as prepared by the Clerk.
The matter of a FORMAL HEARING is held on the following license:
CLASS B (Victualer)
Romar Inc., d/b/a House Café, 520 Central Avenue, Pawtucket RI . LIC #10246.
Representing the city is Frank J. Milos, Assistant City Solicitor
Representing applicant is Maurice Caron, Attorney at Law.
Mr. Milos makes reference to the certificate of revocation issued by the RI Secretary of State to Romar Inc., dated July 10, 2001, which states that the corporation status was revoked on May 18, 2001. He states that as of this date the corporation status has not been reinstated.
Mr. Milos states the city has a problem with a business license operating that has no corporate entity holding the license. In order to obtain a liquor license you must qualify to hold this license. A person residing in the state would qualify to hold a license as well as a corporation registered with the Secretary of State Office in good standing would qualify to hold a license. Romar Inc., is neither.
Mr. Milos also states that there was a bankruptcy order previously filed; however, this is not an issue and submits an order dismissing the case, issued by the United States Bankruptcy Court dated July 10, 2001.
Mr. Milos recommends that this license be revoked or suspended indefinitely.
Maurice Caron, Attorney representing Romar Inc., states that he does not agree with Mr. Milos’s interpretation, He asks that this matter be laid on the table until the corporation is reinstated. Mr. Caron states that his clients will turn the license into the City Clerk until the matter is resolved.
Councilor Wildenhain states that he will ask for a suspension of this license until the corporation status is reinstated. He states at this time there is no authority allowing this corporation to operate.
Councilor Wildenhain asks where Robin Picard, the major stockholder of this corporation is, and asks why she did not attend this meeting, as she was issued a summons to appear.
Mr. Caron states that Ms. Picard is out of the state and is on vacation. Her daughter is present to verify the fact. Mr. Caron furthers asks that this matter be tabled for two weeks.
Councilor Wildenhain states that because of the summer schedule the first meeting in August is the next meeting that this item will be taken up, and asks if this is agreeable to all parties.
Mr. Caron states that it is agreeable.
Councilor Wildenhain states that the City of Pawtucket would be liable if this business were allowed to continue operating.
The hearing is closed.
THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
Upon motion made by Councilor Wildenhain, seconded by Councilor Bray, the following license is suspended until the August 8, 2001, meeting when the license holder will be given the opportunity to present the reinstated corporation status issued by the Secretary of State.
