December 19, 2001

 

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, December 19, 2001, at seven fifty o’clock p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – Chairman Barry; Councilors Bray, Carr, Grebien, Hodge, Moran and Wildenhain.

 

Absent - Councilors Clemente and Hoyas.

 

Chairman Barry presides.

 

 

The reading of the records of December 5, 2001, is dispensed with and the records are approved as prepared by the Clerk.

 

A PUBLIC HEARING is held on the following application for license, advertised for this time:

 

CLASS B (Victualer)

 

Business Investment Group Inc. d/b/a Ken’s Place, 326 Cottage St. LIC#10303

(Transfer from Gabe’s Sports Pub Inc., formerly at 945 Mineral Spring Avenue)

 

Representing applicant is Monica Horan, Attorney, 393 Armistice Blvd., Pawtucket, RI.

 

Applicant Kenneth Zuckerman, 1484 Phoenix Ave., Cranston, RI.

 

Mr. Zuckerman owns the property at 326 Cottage Street, which was the old depot building.  He plans to develop the building into a Pub style restaurant, which has been approved by zoning.

 

Mr. Zuckerman recently developed the property across the street, which greatly enhanced the neighborhood. 

 

He states there is ample parking, as the building is on approximately six acres of land.

 

Mr. Zuckerman states that he is presently negotiating with a national chain to operate the business; the license will be held by Business Investment Group, Inc.  He states he is not looking to have a bar, his plans are for a family style restaurant.

 

The entrance will be on the Freight Street side of the building.

 

Mr. Zuckerman states that the time frame for opening is unknown at this time.

Upon motion made by Councilor Wildenhain, seconded by Councilor Moran, the following license is APPROVED on a unanimous voice vote:

A FORMAL HEARING is held on the following license:

 

CLASS B (Victualer)

 

Eugenio Gibau & Belarmino Darosa, d/b/a Malibu Bar & Grille, 602 Smithfield Avenue LIC#10298

 

STIPULATION:

 

1.       Entertainment allowed 1 day per week on either Fridays or Saturdays.

 

Representing the city of Pawtucket is Frank J. Milos, Jr., Esq., Assistant City Solicitor.

 

Carl Levin, Attorney, representing license holder.

 

Also present at hearing is Stenographer Sandra Bachini Gaboriault.

Upon motion made by Councilor Clemente, seconded by Councilor Grebien, the following STIPULATIONS are added to the following license on a unanimous voice vote:

 

CLASS B (Victualer)

STIPULATION:

 

1.   Entertainment allowed 1 day per week on either Fridays or Saturdays.

 

 ADDED

 

2.      Hire a detail police officer on Friday and Saturday nights.

3.      Back doors are to be kept closed at all times.

 

Communication from Arcaro, Belilove and Kilodney, Attorneys at Law, objecting to the transfer of Class B (Victualer) liquor license of Judge Kelley’s Inc., d/b/a Kelley’s Corner Pub, 584 Smithfield Avenue to The Five B’s LLC in the total amount of $833.79 is READ AND ORDERED FILED.

 

           

A PUBLIC HEARING is held on the following application for license, advertised for this time:

(Transfer from Judge Kelley’s Inc. (by Phyllis A. Kelley, Executrix) d/b/a Kelley’s Corner Pub)

 

Representing the applicant is George McDonald, Attorney, Cranston, RI.

 

Applicant David T. Bannon, Block Island, RI

 

Mr. McDonald states the applicant plans on running a family type business.  The business will be the same as it has been for the past 30 years.

 

Mr. Bannon  states that his oldest son will be running the business.  Any entertainment will be low key, only a juke box.

 

Mr. Bannon states that his previous experience was owning the Sunshine Lounge years ago.  All employees will be TIPS or similar certified.

 

There are no other speakers.

Cape Verdean American Community Development to serve alcoholic beverages at a New Year’s Eve Fest Fundraiser at 120 High Street on the following dates:

 

Saturday, December 29, 2001, from 8:00 p.m. – 12:30 a.m.

Sunday,   December 30, 2001, from 8:00 p.m. – 12:30 a.m.

Monday,  December 31, 2001, from 8:00 p.m. – 12:30 a.m.

 

 

THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.

 

Upon motion made by Councilor Clemente, seconded by Councilor Bray, the following license is APPROVED with the EXCEPTION of Sunday, December 30, 2001, on a unanimous voice vote:
