Pawtucket Board of License Commissioners
December 5, 2001
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, December 5, 2001, at eight o’clock p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Barry; Councilors Clemente, Grebien, Hodge, Moran and Wildenhain.
Absent - Councilors Bray, Carr and Hoyas.
Chairman Barry presides.
The reading of the records of November 20, 2001, is dispensed with and the records are approved as prepared by the Clerk.
A public hearing is held on the following application for license advertised for this time:
CLASS B (Victualer)
Jean B. Vitali d/b/a Shots, *520 Central Avenue LIC#10301
(transfer from Beef Hearth Inc., d/b/a Chelo’s 825 Newport Avenue_
*STIPULATION PREVIOUSLY AT 520 CENTRAL AVENUE
1. All doors shall be kept closed at all times.
2. No loitering of patrons outside the building.
3. A police officer shall be hired on Friday and Saturday evenings to patrol the exterior of the building.
4. No alcoholic beverages outside the building at any time.
5. Clear area of any debris before leaving for the night.
Speaking in favor is William Burke, Attorney, 75 Park Place, Pawtucket, RI, representing applicant.
Mr. Burke states that Mrs. Vitali has had a liquor license at this location before and is seeking to regain the license in her name.
Councilor Wildenhain discusses the stipulations which were placed on the previous license holder and states that he will drop the 3rd stipulation for 90 days (a police officer shall be hired on Friday and Saturday evenings to patrol the exterior of the building) in order to give the new owners an opportunity to conduct business without this stipulation.
There are no other speakers.
The Hearing is closed.
Upon motion made by Councilor Wildenhain, seconded by Councilor Moran, the following application for license is GRANTED on a unanimous voice vote, with the following STIPULATIONS:

*STIPULATIONS:

THE FOLLOWING STIPULATION IS DROPPED FOR A 90 DAY PERIOD:
A police officer shall be hired on Friday and Saturday evenings to patrol the exterior of the building.
THE CHAIR RECOGNIZES COUNCILOR HODGE.
Upon motion made by Councilor Hodge, seconded by Councilor Clemente, the following is approved on a unanimous voice vote:
In conformity with Section 3-8-1 of the General laws of the State of Rhode Island, Class C liquor establishments are hereby entitled to be open on New Year’s Day, 2002.
THE CHAIR RECOGNIZES COUNCILOR HODGE.
Upon motion made by Councilor Hodge, seconded by Councilor Grebien, the following is approved on a unanimous voice vote:
In conformity with Chapter 242 of the Public laws of Rhode Island, 1962, Class B liquor establishments are hereby entitled to remain open on New Year’s morning, January 1, 2002, until 3:00 a.m. Alcoholic beverages CANNOT be sold after the usual closing hour of 1:00 a.m.

With majority consent of the Council, Councilor Clemente introduce the following communication:

THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.
With majority consent of the Council, the following motion made by Councilor Clemente, seconded by Councilor Wildenhain, is passed on a unanimous voice vote:
The Clerk is instructed to issue a Summons to Eugenio Gibau & Belarmino Darosa d/b/a Malibu Bar & Grille, 602 Smithfield Avenue, Pawtucket, RI, to appear at a FORMAL HEARING on Wednesday, December 19, 2001, regarding an incident at the club on December 2, 2001.
Upon motion made by Councilor Hodge, seconded by Councilor Grebien, the meeting is adjourned at eight nine o’clock p.m.
