Pawtucket Board of License Commissioners

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 25, 2001, at eight o’clock p.m. in the City Council Chamber, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – Chairman Barry, Councilors Bray, Carr, Clemente, Grebien, Hodge, Moran, and Wildenhain.
Absent –Councilor Hoyas.
Chairman Barry presides.
The reading of the records of April 11, 2001, is dispensed with and the records are APPROVED as prepared by the Clerk.
THE FOLLOWING PETITION FOR LICENSE IS LAID ON THE TABLE ON A UNANIMOUS VOICE VOTE:
Petition of Latin Sports Inc., d/b/a Discoteca 2000, 327 Barton Street, LIC#10176 requesting permission to remain open until 2:00 a.m. on Fridays and Saturdays, and the night before a legal Rhode Island holiday.
Communication from George L. Kelley, III, Chief of Police, to the Pawtucket Board of License Commissioners. (Police log for services at Macondo LLC Club from September 1, 2000, to April 11, 2001.) IS READ AND ORDERED FILED.
Communication from Marty C. Marran, Attorney at Law, to the Pawtucket Board of License Commissioners. (Withdrawing request for 2:00 a.m. closing of Macondo LLC.) IS READ AND ORDERED FILED.
THE FOLLOWING PETITION FOR LICENSE IS WITHDRAWN WITHOUT PREJUDICE ON A UNANIMOUS VOICE VOTE:
Petition of Macondo LLC., 242 Middle Street, LIC#10283 requesting permission to remain open until 2:00 a.m. on Fridays and Saturdays, and the night before a legal Rhode Island holiday.
Communication from George L. Kelley, III, Chief of Police, to the Pawtucket Board of License Commissioners. (BV Liquor License victualling compliance checks.) IS READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR MORAN:
With majority consent of the Council the following motion made by Councilor Moran, seconded by Councilor Hodge, is PASSED on a unanimous voice vote.
The Clerk is instructed to send a communication to Commander John Whiting asking his recommendation on how to handle those Class BV Liquor businesses that do not have operating kitchens and also what criteria is used to determine the extent of kitchen requirements.
The Clerk is further instructed to contact the R I Health Department to request information regarding how they inspect Class BV liquor facilities.
The Council is asking for the following information:
1. Does the State Health Department manually inspect each location yearly?
2. Are local boards notified if an establishment is not in compliance?
3. If an establishment is not in compliance what do local licensing board’s do in this situation?
4. Are there any records of other communities in Rhode Island where Class BV establishments are operating without kitchen facilities?

Upon motion made by Councilor Bray, seconded by Councilor Grebien, the meeting is adjourned at eight ten o’clock p.m.
