A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 19, 2000, at eight o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, Rhode Island.
Present – Chairman Barry, Councilors Bray, Carr, Clemente, Grebien, Hodge, Hoyas, Moran and Wildenhain.
Absent – 0
Chairman Barry presides.
The reading of the records of January 5, 2000 is dispensed with and the records are APPROVED as prepared by the Clerk.
The matter of a formal hearing on the following license is taken up:

THE CHAIR RECOGNIZES COUNCILOR BRAY
With majority consent of the Council, Councilor Bray introduces the following communication:
Communication from Joseph A. Bevilacqua, Attorney, representing Rick’s Liquor, Inc., 746 Broadway, Pawtucket, to Chairman John J. Barry, III requesting a continuance of the Formal Hearing scheduled for January 19, 2000.
Upon motion made by Councilor Bray, seconded by Councilor Hodge the following communication is READ AND ORDERED FILED.

Upon motion made by Councilor Bray, seconded by Councilor Hodge, the Formal Hearing is again RESCHEDULED for February 9, 2000, at 7:30 p.m. on the following license:

Communication from Commander Stephen P. Ormerod, to Chief George L. Kelley, III, (Underage liquor compliance checks – Class B, C, and D licenses.) is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR BRAY
With majority consent of the Council, the following motion made by Councilor Bray, seconded by Councilor Hodge is PASSED on a unanimous voice vote:
The clerk is instructed to summons all Class B, C, and D license holders listed as first time violators in the underage liquor compliance checks conducted by the Pawtucket Police Department, to appear at a FORMAL HEARING on February 9, 2000, at 7:30 p.m. regarding police allegations of selling alcoholic beverages to minors.
In addition, if violators wish to avoid a formal hearing on the merits, it is possible for them to resolve this matter by way of an admission of the facts which have been alleged against them. In consideration of an affirmative plea of “nolo contendere” (no contest) to the charges as set forth in the Summons, the matter would be resolved in lieu of a hearing. The conditions of the plea would be as follows:
1. Imposition of fine in the amount of Fifty Dollars ($50.00), for the first time offenders.
2. Mandatory attendance by the licensee at a training program which is to be established by the Pawtucket Police Department, the cost of which is to be incurred by the licensee.
3. Any further violations of the aforementioned liquor statutes will result in a mandatory fine of $750.00 and possible suspension and/or revocation of the liquor license after notice and a hearing.

Upon motion made by Councilor Bray, seconded by Councilor Grebien, the meeting is adjourned at eight seven o’clock p.m.
