Pawtucket Board of License Commissioners
June 9, 1999
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 9, 1999, at seven forty-six o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, Rhode Island.
Present - Chairman Barry; Councilors Bray, Clemente, Grebien, Hodge, Hoyas, Moran and Wildenhain.
Absent - Councilor Carr.
Chairman Barry presides.
The reading of the records of May 19, 1999, is dispensed with and the records are approved as prepared by the Clerk.
A public hearing is held on the following application for license advertised for this time:
CLASS B (Victualer)
Churrasqueira DaBeira, Inc., 569 Broadway (transfer location from 434 Broadway) LIC#10257
Speaking in favor is Attorney Richard Kirby, representing applicant.
Mr. Kirby explains that the applicant is purchasing the property and will be closing within 30 days.
The hours of operation will be 12 Noon until 10:00 p.m.; Friday and Saturday closing will be at 11:00 p.m. The license holder runs a lunch and dinner type of restaurant. The restaurant is closed on Tuesdays.
The applicant states that there is enough parking for approximately 25 cars. The parking lot at the location he is moving from is larger, and will accommodate 35 cars.
The applicant states that he will build an enclosure for the rubbish container in the parking lot, which is emptied twice a week at about 8:00 a.m.
Speaking in opposition is Samuel Hanna, 549 Broadway.
Mr. Hanna states that he has lived at this location for 50 years. His property is adjacent to the proposed address for this business. He states that there has always been a liquor establishment at 569 Broadway, and there has always been problems. It has been vacant since 1996, and the area is cleaner and quieter than it has ever been.
Mr. Hanna states that the owners of the Thrifty Plaza, which is right across the street, asked him to state their objections to this transfer.
Mr. Hanna further states that he feels the safety of the children in the neighborhood is a concern. Also, he states that parking will be a big problem.
Mr. Hanna informs the Council that there is a church within 200’ of this address, and that there is a law that prohibits a liquor business moving within 200’ of a church.
Councilor Bray states that Mr. Travers has sent a communication regarding this issue, and the Department of Zoning and Code Enforcement will be conducting an inspection.
The next speaker is Joseph Dalude, 15 Magnolia Street, Pawtucket, RI.
Mr. Dalude states that he has lived at this address for 50 years, and reaffirms everything that Mr. Hanna had previously stated.
Mr. Dalude states that the parking lot will hold no more than 11 cars. He questions where all the cars will be parked if the current address for this restaurant has enough room for 35 cars. He feels that this will be a dangerous situation.
The next speaker is John DaSilva, 12-14 Magnolia Street, Pawtucket, RI.
Mr. DaSilva states that he owns the property across the street from the proposed location; one lot is a house and the other lot is vacant. He can see that parking will be a problem and feels that patrons will be using his empty lot to park their vehicles while going to the restaurant. He states the area is finally quiet and would like to see it stay that way.
Attorney Kirby addresses the parking issue.
Mr. Kirby states that this new location will be much smaller that the existing facility; therefore, a smaller parking lot is required. He states that the current location also has a beauty salon and another business located in the same building, and all these businesses use the same parking lot. He further states that his client will post signs within the restaurant stating that cars will be towed if the cars are parked on private property.

With majority consent of the Council, upon motion made by Councilor Wildenhain, seconded by Councilor Moran, the following application for license is GRANTED WITH STIPULATIONS, on a unanimous voice vote:

STIPULATIONS:
1. There shall be one (1) parking space for every 4 patrons.
2. Dumpster shall be located in parking lot and shall be enclosed within fencing. Rubbish shall be removed at a reasonable time, not to be offensive to the neighbors.
3. Management shall be responsible for traffic control of patrons by posting parking policy inside establishment.
