A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 10, 1997, at seven forty-four o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the members are present and Chairman Barry presides.
The reading of the records of August 20, 1997, is dispensed with and the records are approved as prepared by the Clerk.
A public hearing is held on the following application advertised for this time:
CLASS B (VICTUALER) REQUEST CHANGE FROM CLASS D (FIRST CLASS)
Lucien Pine d/b/a Lucien’s (transfer from Kennedy-Collins Post Department of Rhode Island No. 76, The American Legion) 82 Pawtucket Ave LIC#222.
Speaking in favor:
Lucien Pine, 27 Buffum Street, Pawtucket, RI, applicant.
Steve Maguire, Attorney, 1168 Newport Avenue, Pawtucket, RI.
Mr. Pine states that he has been running the American Legion Post for 12 years and wants to upscale it into a restaurant. The post has been running in the red for 1 1/2 years. He states that he owns the building and has been a chef for 30 years.
Mr. Pine further states that he can use the “Excellent Coffee” parking lot after 5:00 p.m. for his customers.
The Post will continue to exist.
There are no speakers in opposition.
The Hearing is closed.
Upon motion made by Councilor Vieira, seconded by Councilor Hodge the following application for transfer is GRANTED on a unanimous voice vote:

Communication from Latin Sports Inc., d/b/a Discoteca 2000, 327 Barton Street, requesting permission to extend closing hour until 2:00 a.m. on Fridays, Saturdays, and Holidays to allow dancing until that time, is LAID ON THE TABLE.
THE CHAIR RECOGNIZES COUNCILOR VIEIRA.
With majority consent of the Council, the following motion made by Councilor Vieira, seconded by Councilor Hodge, is passed on a unanimous voice vote:
The Clerk is instructed to sent a communication to Jeffrey Greer, Chief of Legal Services, Department of Business Regulations requesting a clarification regarding the closing times for Class B (Victualer) establishments. There is confusion because the victualling house licenses allow the holder to stay open until 2:00 a.m., where the liquor license only allows them to stay open until 1:00 a.m. The question is whether a license holder who has a victualling house license attached to a B license must close at 1:00 a.m., or is the business allowed to stay open until 2:00 a.m., with all alcohol service stopping prior to 1:00 a.m.
The following petition for license is GRANTED on a unanimous voice vote:
CLASS F (Beer & Wine)
St. Teresa’s School/Teacher Club, requesting permission to sell beer & wine at a Fashion Show, Fund Raiser at the Church Hall, 358 Newport Avenue, on Friday, October 24, 1997, from 6:00 p.m. until 11:00 p.m. LIC#19.
Upon motion made by Councilor Vieira, seconded by Councilor Hodge, the meeting is adjourned at seven fifty-six o’clock p.m.
