A regular session of the Pawtucket Board of License Commissioners is held Wednesday, October 8, 1997, at seven forty-five o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the members are present and Chairman Barry presides.
The reading of the records of September 24, 1997, and October 3, 1997, are dispensed with and the records are approved as prepared by the Clerk.
THE CHAIR RECOGNIZES COUNCILOR VIEIRA.
With majority consent of the Council, Councilor Vieira introduces the following communication:
Communication from Richard E. DeLyon, Chief of Police, regarding the application by FAD Food Enterprises Inc., d/b/a Dublin Inn, 216 Columbus Ave., for a proposed outdoor concert.
Upon motion made by Councilor Vieira, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

Communication from FAD Food Enterprises Ltd., d/b/a Dublin Inn, 216 Columbus Avenue, re-submitting request for permission to have outdoor entertainment with live music as well as serving beer, in Parking Lot, on Sunday, October 26, 1997, from 5:00 p.m. - 9:00 p.m. IS TAKEN UP:
Fred Duffy, President of FAD Food Enterprises Ltd., discusses his request for outdoor entertainment. He states that he will not have “Roomful of Blues” on the entertainment program, as was previously scheduled. Because of this, he expects only 100-200 people.
Mr. Duffy submits a petition of the neighbors in the vicinity of the Dublin Inn in support of the concert.
THE CHAIR RECOGNIZES COUNCILOR RABBITT.
With majority consent of the Council, upon motion made by Councilor Rabbitt, seconded by Councilor Hodge, the following request is APPROVED PENDING THE APPROVAL OF THE CHIEF OF POLICE:

A formal hearing regarding the following license is taken up:

Representing the city is Christopher Fay, Attorney, Assistant City Solicitor
Representing the license holder is Hua-Fen Wang, President of Casa DeVicente, Inc., 25 Robinwood Dr., Hope, RI. Ms. Wang was given the opportunity to cross examine the witnesses.
Also present are Captain George Kelley, Sgt. Paul Catorina, Patrolman Jeffrey Allen, Patrolman Charles Devine, and Detective Mark Force, Pawtucket Police Department.

Upon motion made by Councilor Vieira, seconded by Councilor Hodge, the Class B (Victualer) liquor license of Casa DeVicente, Inc., 270 Dexter Street LIC#10187 is PERMANENTLY REVOKED, FOR THE FOLLOWING REASONS:
1. FAILURE TO MAINTAIN CONTROL OF THE ESTABLISHMENT AND ITS PATRONS.
2. DOCUMENTED HISTORY OF SERIOUS AND LIFE THREATENING INCIDENTS ON AND ABOUT THE PREMISES.
3. PERSISTENT AND REPEATED COMPLAINTS OF DISTURBANCES REQUIRING POLICE INTERVENTION.
4. ESTABLISHMENT POSES A CLEAR AND PRESENT DANGER TO THE COMMUNITY.
Upon motion made by Councilor Vieira, seconded by Councilor Bray, the meeting is adjourned at nine fifteen o’clock p.m.
