Pursuant to Rhode Island General Laws 42-56-6 (c) regarding the public health, safety and general public welfare, a special emergency session of the Pawtucket Board of License Commissioners is held on Friday, October 3, 1997, at four thirty-four o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI, on a roll call vote, as follows:

 

Ayes - President Barry, Councilors Bray, Butler, Cute, Doyle, Hodge, Rabbitt and Vieira.

 

Noes - 0.

 

All the members are present except Councilor Moran; Chairman Barry Presides.

 

Communication from Council President, John J. Barry, III, calling an Emergency Special Session of the Pawtucket City Council sitting as the Pawtucket Board of License Commissioners, to be held on Friday, October 3, 1997, at 4:30 p.m. is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILOR CUTE.

 

With majority consent of the Council, Councilor Cute introduces the following communication:

Upon motion made by Councilor Cute, seconded by Councilor Vieira, the following communication is READ AND ORDERED FILED:

Representing the City is Christopher Fay, Attorney, Assistant City Solicitor

 

Representing the license holder is Hua-Fen Wang, President of Casa DeVicente, Inc., 25 Robinwood Dr., Hope, RI. Ms. Wang was given the opportunity to cross examine the witnesses.

 

Also present are Captain George Kelley and Sgt. Paul Catorina, Pawtucket Police Department.

Upon motion made by Councilor Vieira, seconded by Councilor Hodge, the Class B (Victualer) liquor license of Casa DeVicente, Inc., 270 Dexter Street LIC#10187 is SUSPENDED PENDING ANOTHER FORMAL HEARING ON THE MERITS, SCHEDULED FOR WEDNESDAY, OCTOBER 8, 1997, FOR THE FOLLOWING REASONS:

 

1.         FAILURE TO MAINTAIN CONTROL OF THE ESTABLISHMENT AND ITS PATRONS.

2.         DOCUMENTED HISTORY OF SERIOUS AND LIFE THREATENING INCIDENTS ON AND ABOUT THE PREMISES.

3.         PERSISTENT AND REPEATED COMPLAINTS OF DISTURBANCES REQUIRING POLICE INTERVENTION.

4.         ESTABLISHMENT POSES A CLEAR AND PRESENT DANGER TO THE COMMUNITY.

 

The reason for a second hearing is to give the license holder an opportunity to seek Counsel.

 

Upon motion made by Councilor Vieira, seconded by Councilor Bray, the meeting is adjourned at five thirty-five o’clock p.m.
