November 5, 1997

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, November 5, 1997, at seven thirty-five o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the members are present except Councilors Butler and Hodge; Chairman Barry presides.

 

The reading of the records of October 22, 1997, is dispensed with and the records are approved as prepared by the Clerk.

 

A public hearing is held on the following application for license advertised for this time:

 

CLASS B (VICTUALER) - TRANSFER AND RENEWAL

 

Checkmate Pizza Inc., d/b/a Checkmate Pizza, 1-3 Garden Street (transfer from 11 Benefit Street) LIC#231.

 

Speaking in favor is Michael F. Horan, Attorney, 393 Armistice Blvd., Pawtucket, RI, representing applicant.

 

Anastosios Thomaidis, 19 Hillside Ave., Providence, RI, applicant.

 

Mr. Horan explains that Checkmate’s liquor license was held at 11 Benefit Street and he is requesting the Council’s approval to change location to the former Rides Grille building located at 1-3 Garden Street. The applicant will operate a family style restaurant at this location, and will continue to operate the Checkmate Pizza on Benefit Street without a liquor license. This new location will be an additional restaurant.

 

The hours will be 11:00 a.m. until 11:00 p.m. There will not be any entertainment. There will be 8 - 10 employees and they are all TIPS certified.

 

After questioning by Councilor Vieira, Mr. Thomaidis states that the bar area has 6 bar stools, and this area will be used as a waiting area only. Mr. Vieira asks if the applicant would have any objection to a stipulation that there shall be no entertainment at this establishment.

 

Mr. Thomaidis replies that he has no objections.

 

There are no speakers in opposition.

 

The hearing is closed.

 

Upon motion made by Councilor Vieira, seconded by Councilor Rabbitt, the following application for transfer is GRANTED with the following STIPULATIONS, on a unanimous voice vote:

 

1.         THERE SHALL BE NO ENTERTAINMENT

Councilor Vieira refers to a recent incident at the Club, which left the neighbors quite concerned.

 

Mr. Riendeau explains that this was a very unusual incident. There were some late customers arriving at about 12 Midnight, as he was cleaning the Club. They were not members and he did not know them. The police were called as soon as trouble started.

 

Councilor Vieira explains that a Class D liquor license is for members only, and wishes to make the officers more aware of this requirement. Councilor Vieira believes that this was an isolated incident and hopes that the Club will not allow this to happen again in the future.

5.         Pawtucket residents shall be given preference for employment.

6.         A detail officer shall be hired for any function with more than 250 people.

1.         On Friday, Saturday and Sunday evenings there will be two security officers on duty at all times.

5.         No more than 76 people in the building, per order of the Fire Chief.

6.         There will be no Wednesday specials or any other specials on any nights per State Law Chapter 7, Section 3-7-26.

7.         Entertainment shall be limited to Jazz, Blues, Country & Western, Irish, Oldies, and other similar types of music.

1.         Must close at Midnight Sunday - Thursday.

2.         Friday & Saturday must close at 1:00 AM.
