February 19, 1997

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 19, 1997, at seven thirty o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the members are present except Councilors Cute and Rabbitt; Chairman Barry presides.

 

The reading of the records of February 5, 1997, is dispensed with and the records are approved as prepared by the Clerk.

 

Communication from Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the Class A liquor license transfer of Haxton’s Liquor’s Inc., 465 Lonsdale Ave., to Lonsdale Liquors Inc., in the amount of $118,466.69 is READ AND ORDERED FILED.

 

Communication from Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the Class A liquor license transfer of Haxton’s Liquor’s Inc., 465 Lonsdale Ave., to Lonsdale Liquors Inc., in the amount of $99,166.99 is READ AND ORDERED FILED.

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, Councilor Vieira introduces the following:

 

Communication from Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the Class A liquor license transfer of Haxton’s Liquor’s Inc., 465 Lonsdale Ave., to Lonsdale Liquors Inc., in the amount of $10,344.67.

 

Communication from Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the Class A liquor license transfer of Haxton’s Liquor’s Inc., 465 Lonsdale Ave., to Lonsdale Liquors Inc., in the amount of $69,282.85.

 

Communication from McLaughlin & Moran Inc., objecting to the Class A liquor license transfer of Haxton’s Liquor’s Inc., 465 Lonsdale Ave., to Lonsdale Liquors Inc., in the amount of $19,202.52.

 

Communication from Providence-Newport Distributing Co., objecting to the Class A liquor license transfer of Haxton’s Liquor’s Inc., 465 Lonsdale Ave., to Lonsdale Liquors Inc., in the amount of $1,195.11.

Upon motion made by Councilor Vieira, seconded by Councilor Butler, the following communications are READ AND ORDERED FILED:

A public hearing is held on the following application for license advertised for this time:

 

CLASS A -

 

Lonsdale Liquors, Inc., (transfer from Haxton’s of Pawtucket, Inc.) 465 Lonsdale Avenue. LIC#215.

 

Speaking in favor is Michael Brophy, 3010 Post Road, Warwick, RI, Attorney, representing the applicants.

 

Mr. Brophy states that the applicants have hired a manager who is TIPS trained.

 

The next speaker is Karen Nassi, 46 Oak Hill Dr., Cranston, RI, applicant.

 

Ms. Nassi has not determined if she will be working. She states her experience is running a grocery store in Providence. She has not run a liquor store before.

 

She states that the building will be revamped. There will be no changes to the business. She has a friend who used to own a liquor business who has agreed to help her learn this business. The hours will be 9:00 a.m. - 10:00 p.m. Monday - Saturday. She understands that there have been problems there in the past.

 

The next speaker is Dana Gaebe, 128 Dorrance Street, Providence, RI, attorney representing Haxton’s Liquors.

 

Mr. Gaebe states that he spoke with Mr. Kolodney, who stated that the claimants that he represents will withdraw their objections upon receipt of information from Mr. Gaebe on a financial arrangement. He also spoke with two of the three other claimants who are willing to go along with the arrangement. He will speak with the third claimant tomorrow.

 

There are no speakers in opposition.

 

The hearing is closed.

 

Upon motion made by Councilor Vieira, seconded by Councilor Butler, the following application for transfer of liquor license is APPROVED UPON SATISFACTION OF ALL CLAIMS, AND WITH THE FOLLOWING STIPULATION TO REMAIN INTACT:

ALL CURRENT EMPLOYEES, AS WELL AS ANY FUTURE EMPLOYEES, SHALL BE TIPS CERTIFIED.

 

CLASS A -

 

Lonsdale Liquors, Inc., (transfer from Haxton’s of Pawtucket, Inc.) 465 Lonsdale Avenue. LIC#215.

 

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, the following motion made by Councilor Vieira, seconded by Councilor Butler, is passed on a unanimous voice vote:

 

The Clerk is instructed to send a communication to the Liquor Control Administrator, requesting that the hearing for Casa DeVicente be expedited as soon as possible.

 

THE CHAIR RECOGNIZES COUNCILOR MORAN.

 

With majority consent of the Council, the following motion made by Councilor Moran, seconded by Councilor Bray, is passed on a unanimous voice vote:

 

The Clerk is instructed to send a communication to Christopher Fay, Assistant City Solicitor, requesting a status report on the liquor hearing on J.R. $av-On Liquors.

 

Upon motion made by Councilor Vieira, seconded by Councilor Hodge, the meeting is adjourned at seven fifty-two o’clock p.m.
