A regular session of the Pawtucket Board of License Commissioners is held Wednesday, August 6, 1997, at seven forty-six o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the members are present and Chairman Barry presides.
The reading of the records of July 23, 1997, is dispensed with and the records are approved as prepared by the Clerk.
A public hearing is held on the following application advertised for this time:
CLASS A
LARCO Inc. d/b/a Colonial Liquors (transfer from Nunes Colonial Liquors of Pawt. Ltd., by William J. Delaney, Receiver for Nunes Colonial Liquors of Pawt., Ltd. P.M. No. 96-6016, 128 Summit Street. LIC#227
Speaking in favor is William J. Delaney, Attorney, 10 Weybossett Street, Providence, RI, representing applicant.
Mr. Delaney is the Court appointed receiver for Nunes Colonial Liquors. He sold the assets to LARCO free and clear of all liens per order of Superior Court. They have agreed to pay all city taxes and will get a Certificate of Good Standing from the Rhode Island Division of Taxation.
The property owner, Mr. Lopes, will run the store as he has been doing.

Upon motion made by Councilor Vieira, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

Upon motion made by Councilor Vieira, seconded by Councilor Butler, the Class B (Victualer) liquor license of Cape Verdean American Lounge, Inc. d/b/a Lisboa A Noite, 17 Exchange Street, LIC#10051, is SUSPENDED FOR FIVE (5) DAYS BEGINNING AT MIDNIGHT WEDNESDAY, AUGUST 6, 1997, on a unanimous voice vote, for the following reasons:
1. FOR VIOLATIONS OF RI LIQUOR LAWS, SPECIFICALLY NARCOTIC TRAFFICKING IN THE BUILDING AND/OR ON THE PROPERTY OF THE LICENSED ESTABLISHMENT.
2. FOR OPERATING A PUBLIC NUISANCE.
IN ADDITION TO THE SUSPENSION, A FINE OF $500 IS IMPOSED.

A public hearing is held on the following application for license advertised for this time:
CLASS B (VICTUALER)
Vitali d/b/a Kopy Kats (transfer from D & O Inc., d/b/a Hooligans, by Louis A. Geremia, Trustee for D & O Inc., BK No. 97-10697, 520 Central Avenue LIC#226.
Speaking in favor is John Sabatini, Attorney, 716 Central Avenue, Pawtucket, RI, representing applicant.
Mr. Sabatini states that D & O Inc., went through Federal Bankruptcy Court. Applicant has paid all outstanding licensing fees and all city taxes will be paid. His client will operate the business as the previous owner did.
Speaking in favor is Marcus J. Vitali, 43 Langdon Avenue, Pawtucket, RI, for applicant.
Mr. Vitali states that they will have the same entertainment as when they owned Archies, which is 2 or 3 piece bands. This is less than the entertainment that Hooligan’s had.
Mr. Vitali sates that he will get letters from the Salvation Army and Apex if it is needed.
Mr. Vitali also states that there were no problems when they owned Archies.
Speaking in opposition is Lance R. Langborg, 30 Burke Street, Pawtucket, RI.
Mr. Langborg is the spokesman for the neighbors. He states that they are not opposed, but they do have concerns, as follows:
1. Entertainment - There are rumors about topless dancers or waitresses.
2. Illegal Parking - People have disregarded the parking signs. They park too close to the corners of street making it difficult for fire and rescue runs.
3. Debris Outside - Found in past, bottles, contraceptives, needles.
4. Delivery trucks park on Burke Street for 20 minutes to deliver beer.
Mr. Langborg states that if there are problems, he will be back.
Mr. Vitali states that there are no dancing girls. He has been cleaning up the area, and there will be no more deliveries in the back.

Upon motion made by Councilor Doyle, seconded by Councilor Moran, the following application for license transfer is GRANTED on a unanimous voice vote, with the following STIPULATIONS:
1. LICENSE SHALL BE ISSUED ONLY WHEN THE APPLICANT FURNISHES LETTERS FROM THE SALVATION ARMY AND TEKNOR APEX ALLOWING THE USE OF THEIR PARKING LOTS.
2. ENTERTAINMENT SHALL BE NO DIFFERENT THAT WHAT WAS HELD AT ARCHIES

Upon motion made by Councilor Bray, seconded by Councilor Butler, the Class B (Victualer) liquor license of Ilha Verde Club, Inc., 447 Mineral Spring Avenue, LIC#10068, is SUSPENDED FOR TEN (10) DAYS BEGINNING AT MIDNIGHT THURSDAY, AUGUST 7, 1997, on a unanimous voice vote, for the following reason:
1. FOR VIOLATIONS OF RI LIQUOR LAWS, SPECIFICALLY NARCOTIC TRAFFICKING IN THE BUILDING AND/OR ON THE PROPERTY OF THE LICENSED ESTABLISHMENT.
IN ADDITION TO THE SUSPENSION, A FINE OF $1000 IS IMPOSED.
