A regular session of the Pawtucket Board of License Commissioners is held Wednesday, November 20, 1996, at seven fifty-five o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the members are present and Chairman Barry presides.

 

The reading of the records of November 6, 1996, is dispensed with and the records are approved as prepared by the Clerk.

 

A public hearing is held on the following application advertised for the period beginning DECEMBER 2, 1996, AND ENDING DECEMBER 1, 1997, and no person or persons appearing to object thereto, is GRANTED ON A UNANIMOUS VOICE VOTE:

 

CLASS D (FIRST CLASS)

Communication from Christopher E. Fay, Assistant City Solicitor to Councilor Dave Moran. (J.R. $av-On Liquors Inc.) is READ AND ORDERED FILED.

 

THE FOLLOWING LICENSE RENEWAL WAS LAID ON THE TABLE AT THE MEETING HELD NOVEMBER 6, 1996, IS AGAIN TAKEN UP AND IS GRANTED, PENDING NOTIFICATION FROM THE LIQUOR CONTROL ADMINISTRATOR REGARDING A DECISION ON THIS CASE.

THE FOLLOWING LICENSE RENEWALS WERE LAID ON THE TABLE AT THE MEETING HELD NOVEMBER 6, 1996, AND ARE AGAIN TAKEN UP, and are LAID ON THE TABLE with the understanding that the license holders are allowed to remain open until the December 11, 1996, meeting, on a unanimous voice vote:

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, the following motion made by Councilor Vieira, seconded by Councilor Cute, is passed on a unanimous voice vote:

 

The Clerk is instructed to issue a summons to Casa DeVicente, Inc., 270 Dexter Street, LIC#10187, for a formal hearing to be held on Wednesday, December 11, 1996, for the following reasons:

 

1.            Misrepresentation on or about October 19, 1994 to the Board of License Commissioners as to the restaurant business to be operated with an emphasis on food sales, upon which the license was granted. In contrast, the business has subsequently operated as a night club, with greater emphasis on alcohol service and consumption.

 

2.            Disturbances at the location requiring police interaction for incidences at the establishment on or about August 10, 1996, August 11, 1996, October 4, 1996, and October 9, 1996

 

3.            Violations of Rhode Island General Laws 3-1-1 “Victualer House” and 3-7-7 for failing to comply with the victualer house requirements of furnishing food as a substantial part of the business.

 

4.            Violation of the Rules and Regulations of the Rhode Island Department of Business Regulations, Liquor Control Administration, concerning the operation of a victualling house license, under a Class B-V license, respectfully but not limited to:

 

A.            Failing to have kitchen in use

B.            Failure to provide food as a substantial part of the business

C.            Failure to post a menu with prices

D.            Offering snack food in lieu of meals

E.            Failure to make food available during all hours of operation

 

5.            Incidences of various dates in and around the establishment requiring police intervention, the dates of which are set forth in the attached documents attached hereto and incorporated by reference herein.

 

6.            Endangering the health, safety and general welfare of the public in and around the establishment since the issuance of the license.

 

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, the following motion made by Councilor Vieira, seconded by Councilor Rabbitt, is approved on a unanimous voice vote:

 

The Clerk is instructed to send a communication to Jack Gannon, City Solicitor, requesting an advisory opinion regarding liquor license holders who are not operating at the time of renewal, but have filed for renewal of their license. Specifically, the Council wants to know if a liquor licensee, who has ceased to operate under the license granted by the Council, can apply for renewal when they are no longer in business.

 

*DENOTES STIPULATIONS

 

CLASS B (VICTUALER)

 

*CASA DEVICENTE INC, 270 DEXTER STREET

 

1.         The business is to be closed by 1:00 a.m.

2.         Stop serving alcohol by 12:45 a.m.

#3.       There be a uniform detailed officer stationed outside the Casa DeVicente every Friday and Saturday evening commencing 9:30 p.m. to 1:30 a.m. the following morning.

#4.       Casa De Vincente shall continue to employ a bouncer who also will be stationed at the door of the establishment.

#5.       Casa De Vincente shall still have management still routinely checking the parking lot during the course of the evening between the hours of 9:30 p.m. and 1:30 a.m.

 

#PER ORDER OF LIQUOR CONTROL ADMINISTRATOR OCTOBER 21, 1996

 

CLASS D (First Class)

 

*DANTE ALIGHIERI SOCIAL CLUB, 22 Hurley Avenue

 

1.         “Last Call” be held at the establishment at 12:30 a.m. and the establishment be cleared of patrons by 1:00 a.m.

2.         No drinking is allowed outside the establishment.

#3.       Provide security (can hire a private security service) for any and all special functions and also on every Saturday Night from 9:00 p.m. until closing.

4.         Off-duty police officer shall be hired every Saturday, between the hours of 9:00 p.m. and 2:00 a.m. and at all times when there is entertainment.

5.         Must have entertainment license for ALL Club functions.

6.         Officer of Club must be present at ALL functions.

 

#PER LIQUOR CONTROL ADMINISTRATOR

 

The following request for an extension of hours is GRANTED on a unanimous voice vote:

 

Latin Sports Inc d/b/a Discoteca 2000, 327 Barton Street, requesting permission to remain open until 2:00 a.m. on Saturday, December 21, 1996 to hold a Hispanic Christmas Party.

 

Upon motion made by Councilor Vieira, seconded by Councilor Bray, the meeting is adjourned at eight ten o’clock p.m.
