A regular session of the Pawtucket Board of License Commissioners is held Wednesday, May 22, 1996, at seven thirty o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present and Chairman Barry presides.
The reading of the Records of May 8, 1996, is dispensed with and the Records are approved as prepared by the Clerk.
THE CHAIR RECOGNIZES COUNCILOR MORAN.
With majority consent of the Council, the following Motion to amend the Stipulations placed on the Class B (Victualer) liquor license of Bobby’s Banquet Hall Inc., 67 Garrity Street, is passed on a unanimous voice vote:
COUNCILOR MORAN IS TO BE NOTIFIED IN ADVANCE OF MONTHLY MEETINGS.
A Formal Hearing is held on the following license:
CLASS B (VICTUALER)
Elias Dernikos d/b/a City Line Pizza & Restaurant, 590-598 Pawtucket Avenue.
THE CHAIR RECOGNIZES COUNCILOR BRAY.
The following motion made by Councilor Bray, seconded by Councilor Vieira, is passed on a unanimous voice vote:
Upon agreement by the Board and Paul Foster, Attorney for the License holder, the Clerk is instructed to send a FORMAL WARNING AND FINE to Elias Dernikos d/b/a City Line Pizza & Restaurant, 590–598 Pawtucket Avenue, for violating Title 3 UNDERAGE PERSONS, R. I. G. L. 3-8-6 on or about February 1, 1996; Violations of the Stipulations placed on license on various dates in February 1996, and March 1996; other violations of the liquor laws and the fire safety code of the State of Rhode Island; additional violations of Rhode Island State Law occurring on or About March 30, 31, and April 5, 1996.
Any further violations will result in further action by the Board of License Commissioners, including additional fines, suspension or revocation of said license. Also, all current stipulations are to be strictly enforced and shall also include that the detail office be hired for Saturday evenings shall be required to stand outside the door. Further, all Fire Safety Code violations are to be corrected.
The fine shall be in the amount of $250.
Communication from FAD Food Enterprises Ltd., d/b/a The Dublin Inn, 216 Columbus Avenue requesting the Council to reevaluate the stipulations placed on this Class B (Victualer) liquor license is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR CUTE.
The following motion made by Councilor Cute, seconded by Councilor Hodge, is passed on a unanimous voice vote:
The Clerk is instructed to schedule a public hearing regarding the request by FAD Food Enterprises Ltd., to reevaluate the stipulations placed on this license to be held on Wednesday, June 5, 1996; further, the abutting property owners within 200’ shall be notified by mail of said hearing. The cost of the advertising shall be the responsibility of the license holder.
Communication from Joseph E. Gallucci, Liquor Control Administrator, regarding Fernando’s Liquors Inc., (Stay issued and Hearing date set for June 3, 1996) is READ AND ORDERED FILED.
Communication from Sandi Reeves, executive legal Secretary, Law Department, regarding Fernando’s Liquors - Stay issued and Hearing date set for June 3, 1996, before the RI Liquor Control Administrator is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR DOYLE.
The following motion made by Councilor Doyle, seconded by Councilor Moran, is passed on a unanimous voice vote:
ALL FORMAL HEARINGS WHICH ARE CANCELLED, IN WHICH A STENOGRAPHER WAS HIRED AND CANNOT BE CANCELLED, THE LICENSEE SHALL PAY THE COST OF SAID STENOGRAPHER.

Councilor Rabbitt introduces the following communication:
Communication from Carousel Sports Lounge, Inc., 507 Armistice Blvd., requesting permission to add a 20’ x 23’ outdoor patio in the rear of the Carousel Sports Lounge.
Upon motion made by Councilor Rabbitt, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

THE CHAIR RECOGNIZES COUNCILOR RABBITT.
With majority consent of the Council, the following motion made by Councilor Rabbitt, seconded by Councilor Butler, is passed on a unanimous voice vote:
PERMISSION IS GRANTED TO CAROUSEL SPORTS LOUNGE, INC., 507 ARMISTICE BLVD., TO ADD A 20’X23’ OUTDOOR PATIO IN THE REAR OF THE CAROUSEL SPORTS LOUNGE FOR A 30 DAY TRIAL PERIOD, WITH THE FOLLOWING STIPULATIONS:
1. EXIT/ENTRANCE WILL BE FROM THE BUILDING ONLY.
2. PRIVACY SLATS WILL BE INSTALLED TO THE EXISTING FENCE AND A NEW FENCE WILL BE INSTALLED TO ENCLOSE THE PATIO. THIS SPACE WILL OCCUPY 5-6 TABLES AND AN OUTDOOR RUG.
3. NO GLASS WILL BE PERMITTED ON THE PATIO.
4. PATIO WILL CLOSE BETWEEN 10:00 PM - 11:00 PM.
Upon motion made by Councilor Vieira, seconded by Councilor Bray, the meeting is adjourned at seven forty-two o’clock p.m.
