A regular session of the Pawtucket Board of License Commissioners is held Wednesday, July 10, 1996, at seven thirty-four o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present except Councilor Rabbitt, and Chairman Barry presides.
The reading of the Records of June 19, 1996, is dispensed with and the Records are approved as prepared by the Clerk.
Communication from Joseph E. Gallucci, Liquor Control Administrator, regarding Fernando’s Liquors Inc., (new hearing date), is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR DOYLE.
With majority consent of the Council, the following motion made by Councilor Doyle, seconded by Councilor Vieira, is passed on a unanimous voice vote:
The Clerk is instructed to send a communication to the City Solicitor requesting a copy of the mutual-agreed-to statement of facts on the Fernando’s Liquors case, which was due in the Liquor Control Administrator’s office by July 5, 1996. Councilor Doyle is requesting a copy of said document prior to the de novo hearing on this matter.
Claim of Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the transfer of Class B (Victualer) liquor license of A.M.L. Restaurant Inc., d/b/a Archie’s - The Mill Town Tavern to TEP Restaurant Inc. d/b/a Timothy’s Place, 47 Mendon Avenue, in the total amount of $6,107.24, is READ AND ORDERED FILED.

With majority consent of the Council, Councilor Vieira submits the following claims:
Claim of Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the transfer of Class B (Victualer) liquor license of A.M.L. Restaurant Inc., d/b/a Archie’s - The Mill Town Tavern to TEP Restaurant Inc. d/b/a Timothy’s Place, 47 Mendon Avenue, in the amount of $483.06.
Claim of WWLI Radio objecting to the transfer of Class B (Victualer) liquor license of A.M.L. Restaurant Inc., d/b/a Archie’s - The Mill Town Tavern to TEP Restaurant Inc. d/b/a Timothy’s Place, 47 Mendon Avenue, in the amount of $960.00
Claim of Eastern Utilities, Blackstone Valley Electric Co., objecting to the transfer of Class B (Victualer) liquor license of A.M.L. Restaurant Inc., d/b/a Archie’s - The Mill Town Tavern to TEP Restaurant Inc. d/b/a Timothy’s Place, 47 Mendon Avenue, in the total amount of $8,228.51.
Upon motion made by Councilor Vieira, seconded by Councilor Bray, the following claims are READ AND ORDERED FILED:

A Public Hearing is held on the following application for license advertised for this time:

TEP Restaurant Inc. d/b/a Timothy’s Place, 47 Mendon Avenue LIC#10209 (transfer from A.M.L. Restaurant Inc., d/b/a Archie’s - The Mill Town Tavern)
Speaking in favor is Attorney John Sabatini, 716 Central Avenue, Pawtucket, RI.
Also speaking in favor is Attorney Susan DeBlasio, 1 Park Row, Providence, RI.
Mr. Sabatini states that he is representing A.M.L. Restaurant Inc., Archie’s - The Mill Town Tavern. He states that all the creditors have been paid except for the Blackstone Valley Electric Co; however, he has a check for this claim.
Ms. DeBlasio states that she is representing TEP Restaurant Inc., d/b/a Timothy’s Place. The restaurant is now closed and hopes to open in a couple of weeks. The owners will try to keep the flavor of the Pawtucket institution in this business. She also states that this will be operated as a family type restaurant and the current manager and chef will stay. Mr. & Mrs. Nelson Paine are involved with the operation along with Timothy Paine. The trade name is being changed to Timothy’s Place.
Speaking in favor is Timothy Paine, 46 Kent View Dr., Scituate, RI.
Mr. Timothy Paine is the President of TEP Restaurant Inc. He states that he will keep the piano lounge and that the hours will be the same.
There are no other speakers.

Upon motion made by Councilor Doyle, seconded by Councilor Vieira, the following application for license is GRANTED subject to the release of all outstanding claims:
