A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 20, 1995, at seven forty-five o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present and Chairman Barry presides.
The reading of the Records of September 6, 1995, is dispensed with and the Records are approved as prepared by the Clerk.
Claim of Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the transfer of Class A liquor license of Bino’s International Wine and Spirits Inc., 593 Weeden Street (100% transfer of stockholders) in the total amount of $6,525.87 is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR VIEIRA.
With majority consent of the Council, Councilor Vieira introduces the following:
Communication from Arcaro, Belilove and Kolodney, Attorneys at Law, releasing their objection to the transfer of Class A liquor license of Bino’s International Wine and Spirits Inc., 593 Weeden Street (100% transfer of stockholders) in the total amount of $6,525.87.
Upon Motion by Councilor Vieira, seconded by Councilor Kinder the following Release is READ AND ORDERED FILED:

A Public Hearing is held on the following application for license advertised at this time:

Speaking in favor is Alan Barnes, Attorney, 141 Power Rd. Pawtucket, RI, representing Eunice Goncalves, 6 Homes St. North Providence, RI, applicant.
Mr. Barnes states that this is a 100% stockholder transfer.
Mr. Barnes states that Ms. Goncalves has taken a T.I.P.S. training course and she will also be trained by the current owners of the business as to the day to day operation.
Councilor Vieira states that he met with Ms. Goncalves and is satisfied with the type of business that she will be operating, which will be conducted the in the same manner as the previous owners.
Councilor Vieira also states that the existing stipulations will remain on the license:
1. All employees are to park in the rear.
2. There are to be four designated parking spaces in the front for liquor store customers.
There are no other speakers.

Upon Motion made by Councilor Vieira, seconded Councilor Kinder, the following application for license is GRANTED on an unanimous voice vote, with the following STIPULATIONS to remain in full force and effect:
1. All employees are to park in the rear.
2. There are to be four designated parking spaces in the front for liquor store customers.

Mancini Liquors Inc., 267 Newport Avenue LIC #194 (transfer from RI Prescription Center Inc., 275 Newport Ave.)
Speaking in favor is James Dube, Attorney, 225 East Avenue, Pawtucket, RI, representing Mancini Liquors, Inc.
Mr. Dube introduces the following applicants for transfer:
James Mancini, 20 Lister Dr., Barrington.
Lynn Mancini, 60 Hawthorne Rd., North Providence.
Robert Mancini, 20 Lister Dr., Barrington.
Mr. Dube states that R. I. Prescription Center has been operating for the past 25 years and has held both a Class A & Class E liquor license. Mr. Dube points out that the Class A license is a full privilege license which was transferred pursuent to R.I.G.L. 3-7-3, on September 22, 1971, from Four Corner Liquor Store.
Mr. Dube also states that under Rhode Island General Law 3-7-5 a druggist license (Class E) cannot be split under this section; however, R.I. Prescription Center’s Class A license was obtained under Rhode Island General Law 3-7-3.
Mr. Dube makes reference to Frank Milos’ letter dated September 18, 1995, which renders a legal opinion on this matter.
Mr. Dube addresses the complaint on the docket and states that this does not add to the number of liquor stores in the area. He states that it is the same license only being moved one building away, approximately 100 feet, directly next door to where RI Prescription Center was.
Mr. Dube states that he is aware of Rhode Island Liquor Control Commissioner’s Rule number two which refers to fixed quotas; however, this transfer does not increase the number of Class A licenses in Pawtucket, but retains the same amount allowed.
Speaking in opposition is Kathy Baldi, Attorney, 50 Power Rd. Pawtucket, RI, representing Beverage Hill Liquors Inc. and Town Wine & Spirits, Inc.
Ms. Baldi states that under R.I.G.L. 3-7-5 (Romano vs Daneker case), a Class A & E cannot be split.
Ms. Baldi submits written objection into the public hearing.

Speaking in favor is Joseph Marques, applicant, 6 Malvern Street, Pawtucket, RI.
Mr. Marques states that this transfer is due to the illness of his father, Armindo Marques, who is unable to operate the business. He states that he has been involved in the business for the past 17 years.
Mr. Marques states the there will be no changes in the business and that he is T.I.P.S Certified and is now running the business.
