June 7, 1995.
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 7, 1995, at nine fifteen o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present except Councilor Rabbitt; Chairman Barry presides.
The reading of the Records of May 24, 1995, is dispensed with and the Records are approved as prepared by the Clerk.
A public hearing is held on the following application for license advertised for this time, and no person or persons appearing to object thereto is GRANTED on a unanimous voice vote:
CLASS B (VICTUALER)
Peddlers Inn Inc., (50% change in stockholders)
94 Middle Street, LIC#193.
An INFORMAL HEARING is held on the following license:
CLASS B (Victualer) - Elias Dernikos d/b/a City Line Pizza & Restaurant, 592-594 Pawtucket Avenue.
The first speaker is Elias Dernikos, 590 Pawtucket Ave., owner of City Line Pizza & Restaurant.
Also, interpreting for Mr. Dernikos is Paul Cardoza, 143 Pidge Ave., Pawtucket, RI.
Mr. Dernikos states that the kitchen is in the same building and patrons can order food from the bar area through a window.
Mr. Dernikos states that he will correct the address on the license to include all entrances to the business. He also states that he was unaware of a problem with too many people in the establishment. He said there was an altercation was between 2 or 3 people, who have been banned from his establishment. He is trying to control the noise and has requested, on his own, to have detail police officers on Friday and Saturday evenings. Further, he says that people have left with drinks, but he does not condone it. The bottles outside of his establishment are not from his business. He has told the police to ticket any cars parked illegally.
The next speaker is Franklin Sorel, 281 Lafayette Street, Pawtucket, RI.
Mr. Sorel states that he did not have time to get neighbors together. He is concerned because the restaurant area moved which allows more people in the bar area. He says the place is jammed and that the bar is a nuisance. The music is loud, people are rude and loud, there is fighting; the bar tramples on the rights of the residents. He is asking that the area be kept clean. Further, he says that there have been problems there for the past 2-3 years. He also states that there was an altercation with a police officer recently.
The next speaker is George Carvalhal, 284 Lafayette Street, Pawtucket, RI.
Mr. Carvalhal says that the restaurant sounds like a night club. He says there is too much noise; the music is too loud. His kids can’t sleep and he can’t study. There are liquor bottles, cans, glasses and condoms on the street. He also questions the available parking area. He also says there are between 80-90 people in the establishment on weekends.
The next speaker is Sgt. Richard Rousseau, Pawtucket Police Department.
Sgt. Rousseau states that in the last six months there have been 16 calls to the area and 11 to the establishment. He says the owner has been cooperating with the police.
He further states that the police have been ticketing cars and there has been a detail officer on duty. He says the business closes before 1 a.m.; and, three times people were sent back in the building with beer and mixed drinks. He says the person at the door is lax. He says the maximum allowed is 52 people when the dance floor is used and 72 peoples without dancing. He further states that at times there have been too many people inside the building.
The informal hearing is closed.
THE CHAIR RECOGNIZES COUNCILOR BRAY.
With majority consent of the Council, a Motion made by Councilor Bray, seconded by Councilor Hodge, to place the following Stipulations on the Class B (Victualer) License of Elias Dernikos d/b/a City Line Pizza & Restaurant, 592-594 Pawtucket Avenue, is APPROVED on a unanimous voice vote:
STIPULATIONS:
1. Correct the address with the City Clerk’s Office.
2. Full menu available in bar at all times.
3. Maximum of 51 people in bar when there is a D.J.;
Maximum of 71 people in bar when there is NO D.J. If police determine the number of persons allowed is being exceeded, the business will be closed until there is a formal hearing before the Board of License Commissioners.
4. No alcoholic beverages allowed outside the building.
5. Police detail on Friday & Saturday evenings from 9:30 p.m. until 1:30 a.m.; and any time there is a D.J.
The following application for license is APPROVED on a unanimous voice vote:
CLASS F (Beer & Wine)
St. Anthony’s Church, to sell beer & wine at the Annual Festival at 32 Lawn Avenue on Saturday, June 10, 1995, from 7:00 p.m. - 12 Midnight; Sunday, June 11, 1995, from 7:00 p.m. - 11:00 p.m. LIC #6.
Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the meeting is adjourned at nine forty-six o’clock p.m.
