A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 23, 1994, at eight forty seven o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present and Chairperson Barry presides.
The reading of the Records of March 9, 1994, is dispensed with and the Records are approved as prepared by the Clerk.
Communication from Lt. Steven Johnson, Fire Prevention Officer to Richard J. Goldstein, City Clerk, regarding the Ilha Verde Club, 447 Mineral Spring Avenue IS READ AND ORDERED FILED.
Communication from Frank A. Rendine, P.E., Director, Zoning and Code Enforcement, Regarding the Ilha Verde Club, 447 Mineral Spring Avenue IS READ AND ORDERED FILED.
The Formal Hearing regarding the Class B (Victualer) Liquor License of the Ilha Verde Club, 447 Mineral Spring Avenue IS TAKEN UP.

Christopher Fay introduces the following documents into the Record:
1. Copy of the application of the Ilha Verde Club, 447 Mineral Spring Avenue.
2. Communication from Frank Rendine, P.E., Director, Zoning and Code Enforcement.
3. Two decisions from the Executive Department, Fire Safety Code BOARD OF APPEAL AND REVIEW.
4. Three communications from the Rhode Island State Fire Marshal.

THE CHAIR RECOGNIZES COUNCILOR BRAY.
With majority consent of the Council, Upon Motion made by Councilor Bray, seconded by Councilor Vieira, the CLASS B (Victualer) Liquor License of Ilha Verde Club Inc., 447 Mineral Spring Avenue is SUSPENDED for a period of 30 days beginning at 12:01 A.M. March 24, 1994, and ending at 12:01 A.M. April 23, 1994, unless the kitchen is ready and all fire and other code violations are corrected prior to April 23, 1994, for the following reasons:
1. Failure to maintain an operating kitchen as required to keep a Class B (Victualer) Liquor License under Rhode Island State Law.
2. Failure to maintain your establishment in a safe manner.
Claim of Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the Class A Liquors license transfer of First & Last Liquors Inc. d/b/a First & Last Liquors, 356 East Avenue to Baya Enterprises, Inc. d/b/a First & Last Liquors in the total amount of $4,028.75 IS READ AND ORDERED FILED.
A Public Hearing is held on the following application for license advertised for this time:

Speaking in favor is Herbert Katz, Attorney, 1 Lonsdale Avenue, Pawtucket, RI.
Mr. Katz states that Miss Baya has had a lifelong desire to go into business for herself and she will do so in good faith.
Also speaking in favor is Miss Silvia Baya, 628 Ives Road, Warwick.
Miss Baya states that she will prevent loitering in the lot and keep the lot clean.
There are no other speakers.

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the following application for license transfer is APPROVED on an unanimous voice vote.
