March 9, 1994

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, March 9, 1994, at seven thirty four o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present and Chairperson Barry presides.

 

The reading of the Records of February 23, 1994, is dispensed with and the Records are approved as prepared by the Clerk.

 

THE FOLLOWING APPLICATION FOR LICENSE TRANSFER WAS LAID ON THE TABLE AT THE MEETING HELD FEBRUARY 9, 1994, AND IS AGAIN TAKEN UP:

 

CLASS A

 

Bino’s Liquors Inc., 593 Weeden St. (location change, previously at 50 Ann Mary St.) LIC# 10174

 

Upon Motion Made by Councilor Vieira, seconded by Councilor Kinder, the following application for transfer is APPROVED WITH THE FOLLOWING STIPULATIONS, on a unanimous voice vote:

 

1.         All employees are to park in the rear.

2.         There are four designated parking spaces in the front for Bino’s customers.

3.         There will be a detail officer from 4:00 PM to 8:00 PM Fridays,

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, the following Motion made by Councilor Vieira, seconded by Councilor Kinder, is passed on a unanimous voice vote:

 

The Clerk is instructed to send a communication to Mike Burns, Traffic Engineer, requesting a traffic assessment on Hazel Street.

 

The Formal Hearing regarding CLASS D license of Happy Hour Club, 404 Benefit Street is taken up:

Edward Blais, Attorney, representing the Happy Hour Club

Mr. Fay introduces the following documents into the Record:

 

COPY OF CLASS D LIQUOR LICENSE APPLICATION NO. 10108 FOR THE HAPPY HOUR CLUB, 404 BENEFIT STREET.

THE CHAIR RECOGNIZES COUNCILOR MORAN.

 

With majority consent of the Council, Upon Motion made by Councilor Moran, seconded by Councilor Vieira, the license holders of the Class D liquor license of Happy Hour Club, 404 Benefit Street are fined $400.00 for the following reason:

 

1.         Alleged violations of gambling laws of the State of Rhode Island.

 

Claim of Blackstone Valley Electric Company, objecting to the Class B (Victualer) License transfer of DVK Enterprises Inc. d/b/a Boomer’s Sports Bar and Comedy Club to Latin Sports Inc. d/b/a Discoteca 2000, 327 Barton Street in the total amount of $4,440.49 IS READ AND ORDERED FILED.

 

Claim of Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the Class B (Victualer) License transfer of DVK Enterprises Inc. d/b/a Boomer’s Sports Bar and Comedy Club to Latin Sports Inc. d/b/a Discoteca 2000, 327 Barton Street in the total amount of $761.83 IS READ AND ORDERED FILED.

 

A Public Hearing is held on the following application for license advertised for this time:

 

CLASS B (Victualer)

 

Latin Sports Inc. d/b/a Discoteca 2000, 327 Barton Street (transfer from DVK Enterprises Inc. d/b/a Boomer’s Sports Bar and Comedy Club) LIC#10176

 

Speaking in favor is Mr. Mark Krieger, Attorney, 132 Old River Rd. Lincoln, RI.

 

Mr. Krieger states that there will not be any changes in the operation of the business.

 

He also states that the applicants currently work at the establishment and will run it after the transfer. In the beginning they will be open Thursday through Sunday.

 

He states that there are 3 stockholders in the Corporation.

 

Mr. Kreieger submits RI Certificate of Corporation from the RI Office of the Secretary of States Department and the T.I.P.S. training certificate.

 

There are no other speakers.

 

The Hearing is Closed.

 

Upon Motion made by Councilor Vieira, seconded by Councilors Hodge and Kinder, the following application for license transfer is GRANTED on a unanimous voice vote.

Latin Sports Inc. d/b/a Discoteca 2000, 327 Barton Street (transfer from DVK Enterprises Inc. d/b/a Boomer’s Sports Bar and Comedy Club) LIC#10176

 

Communication from Frank A. Rendine, P.E., Director of Zoning and Code Enforcement regarding violations at the Class B (Victualer) liquor establishment of the Ilha Verde Club Inc., 451 Mineral Spring Avenue IS READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, Councilor Vieira introduces the following Communication:

 

Communication from Frank A. Rendine, P.E. Director, Zoning and Code Enforcement, regarding wiring violations at Ilha Verde Club, 451 Mineral Spring Avenue.

 

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the following Communication is Read and Ordered Filed.

 

Communication from Frank A. Rendine, P.E. Director, Zoning and Code Enforcement, regarding wiring violations at Ilha Verde Club, 451 Mineral Spring Avenue.

 

THE CLERK IS INSTRUCTED TO ISSUE A SUMMONS TO THE OFFICERS OF THE ILHA VERDE CLUB, 447 MINERAL SPRING AVENUE, TO APPEAR ON WEDNESDAY, MARCH 23, 1994, TO ANSWER CHARGES OF WIRING VIOLATIONS.

With majority consent of the Council, the following Motion made by Councilor Vieira, seconded by Councilor Kinder, is passed on a unanimous voice vote:

 

The Clerk is instructed to send a Communication to Frank A. Rendine, P.E. Director Zoning and Code Enforcement, and Lt. Steven Johnson, Fire Prevention Officer, regarding an inspection of the Ilha Verde Club, 447 Mineral Spring Avenue and to take proper steps to ensure that there are no safety hazards.

 

The following Petition for license is approved on a unanimous voice vote.

 

CLASS F-1 (Full Privilege)

 

St. Edward’s Church, to sell alcoholic beverages at an Irish Dance at Weeden Street on Friday, March 18, 1994, from 8:00 PM to midnight. LIC#47

 

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the meeting is adjourned at eight sixteen o’clock p.m.
