Pawtucket Board of License Commissioners.

June 8, 1994.

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 8, 1994, at eight ten o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present and Chairman Barry presides.

 

The reading of the Records of May 25, 1994, is dispensed with and the Records are approved as prepared by the Clerk.

 

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, Councilor Vieira introduces the following Claims:

 

Claim of Arcaro, Belilove, and Kolodney, Attorneys at Law, against the transfer of Class A liquor license of Antonio Fernandes d/b/a Fernando’s Liquors to Fernando’s Liquors, Inc., 558 Broadway, in the total amount of $10,742.56.

 

Claim of Eastern Utilities against the transfer of Class A liquor license of Antonio Fernandes d/b/a Fernando’s Liquors to Fernando’s Liquors, Inc., 558 Broadway, in the amount of $815.03.

 

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder the following Claims are READ AND ORDERED FILED:

Speaking in favor is Fernando S. Cunha, Attorney, 189 Wickenden Street, Providence, RI, representing applicant.

 

Franklin Fernandes, 52 Rand Street, Central Falls, RI.

 

Mr. Cunha states that Franklin Fernandes is the son of the present owner and will be running the business.

 

Councilor Doyle states that there is a discrepancy on the application.

Upon Motion made by Councilor Doyle, seconded by Councilor Kinder, the Public Hearing on the following application is TABLED on a unanimous voice vote:

Fernando’s Liquors Inc., d/b/a Fernando’s Liquors (previous owner Antonio Fernandes d/b/a Fernando’s Liquors) 558 Broadway LIC#182

 

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, Councilor Vieira submits the following Claims:

 

Claim of Eastern Utilities against the transfer of Class B Victualling House license of C.C. & D. D. Inc., d/b/a Dazzle’s, in the amount of $780.34.

 

Claim of Dennis K. DeGuilio in the amount of $6,600.00.

 

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the following Claims are READ AND ORDERED FILED:

 

Claim of Eastern Utilities against the transfer of Class B Victualling House license of C.C. & D. D. Inc., d/b/a Dazzle’s, in the amount of $780.34.

 

Claim of Dennis K. DeGuilio in the amount of $6,600.00.

 

A Public Hearing is held on the following application for license advertised for this time:

DABD & AJD Inc., d/b/a The Home Plate (previous owner C.C. & D.D. Inc., d/b/a Dazzle’s) 602 Smithfield Avenue LIC#183

 

Speaking in favor is Jonathan Oster, Attorney, 936 Smithfield Avenue, Lincoln, RI, representing applicant.

 

Mr. Oster requests that the application be amended to change the Secretary to Anthony DeSanto.

 

Mr. Oster presents a “Letter of Resignation” of the Secretary, Robert Milligan; and Minutes of “Special Meeting of Directors” electing Anthony DeSanto as Secretary.

 

Mr. Oster states that there have been no complaints since the applicants have been running the business.

 

There are no other speakers.

With majority consent of the Council, a Motion made by Councilor Vieira, seconded by Councilor Kinder, to amend the CLASS B (Victualer) application of DABD & AJD Inc., d/b/a The Home Plate, 602 Smithfield Avenue LIC#183, by changing the name of the secretary to Anthony DeSanto is approved on a unanimous voice vote.

 

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the following application for license is GRANTED on a unanimous voice vote:

 

CLASS B (Victualer)

 

DABD & AJD Inc., d/b/a The Home Plate (previous owner C.C. & D.D. Inc., d/b/a Dazzle’s) 602 Smithfield Avenue LIC#183

 

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, a Motion made by Councilor Vieira, seconded by Councilor Kinder, to REMOVE THE STIPULATION PLACED ON DAZZLE’S REQUIRING WILLIAM AND ALDA COLLINS TO SUPERVISE ON EACH AND EVERY EVENING, THE CLOSING OF THE ESTABLISHMENT IN ACCORDANCE WITH STATE LAW AND THE TERMS OF A CLASS B LICENSE is approved on a unanimous voice vote.
