January 5, 1994.
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 5, 1994, at eight nine o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present and Chairman Barry presides.
The reading of the Records of December 17, 1993, is dispensed with and the Records are approved as prepared by the Clerk.
THE ELECTION OF THE CHAIRPERSON OF THE PAWTUCKET BOARD OF LICENSE COMMISSIONERS IS NOW TAKEN UP.
Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, Councilor John J. Barry, III is elected CHAIRMAN of the Pawtucket Board of License Commissioners on a roll call vote, as follows:
Ayes - Councilors Barry, Bray, Demopulos, Doyle, Hodge, Kinder, Moran, Rabbitt, and Vieira.
Noes - 0.
THE ELECTION OF THE VICE-CHAIRPERSON OF THE PAWTUCKET BOARD OF LICENSE COMMISSIONERS IS NOW TAKEN UP.
Upon Motion made by Councilor Rabbitt, seconded by Councilor Kinder, Councilor William D. Vieira, Sr., is elected VICE-CHAIRMAN of the Pawtucket Board of License Commissioners on a roll call vote, as follows:
Ayes - Chairman Barry, Councilors Bray, Demopulos, Doyle, Hodge, Kinder, Moran, Rabbitt, and Vieira.
Noes - 0.
The Formal Hearing regarding CLASS B (Victualer) license of Sully’s Pub Inc., 617-627 Prospect Street & 10 Fortin Ave is taken up.
THE CHAIR RECOGNIZES COUNCILOR VIEIRA.
With majority consent of the Council, Councilor Vieira introduces the following Communication:

Upon Motion made by Councilor Vieira, seconded by Councilor Rabbitt, the following Communication is Read and Ordered Filed:
Communication from Christopher E. Fay, Assistant City Solicitor, regarding the Formal Hearing for Sully’s Pub Inc.
Upon Motion made by Councilor Vieira, seconded by Councilor Rabbitt, the Board accepts the admission of Sully’s Pub Inc., to the allegations as laid out in the police report dated December 5, 1993, and Sully’s Pub Inc., is fined $100 for the Violation, as recommended in the Communication from Christopher E. Fay.
A Public Hearing is held on the following application for license advertised for this time:

G & F Spirits Inc., 139 Benefit Street (transfer location from 738 Central Avenue) LIC #10015
Speaking in favor is Attorney Joseph Lamagna, 50 Summit Street, Pawtucket, RI, representing the applicant.
Mr. Lamagna states that the applicants have been operating Central Avenue Liquors on Central Avenue since 1989 and are requesting approval for a change of location.
They have had no problems with violations of state and city laws. They are aware that there are no objections.
There may be some cosmetic changes.
The two owners will run the store.
Speaking in opposition is Elvira Lopes, 745 England Street, Cumberland, RI.
Mrs. Lopes states that she owns the old January’s and has some people interested in putting in a liquor store at that location and asks if that will be a problem.
There are no other speakers.

A Public Hearing is held on the following application advertised for this time:

Emery Dining Inc., d/b/a Emery’s LeFoyer (transfer from LeFoyer Inc.) 151 Fountain Street LIC #44
Speaking in favor is Attorney Michael Horan, 393 Armistice Blvd., Pawtucket, RI, representing applicant.
Mr. Horan states that the applicant owns Emery’s Catering and has been a Member of LeFoyer for 20 years. He will run the same type of operation as the LeFoyer has been running.
Mr. Emery will enter into an agreement with the LeFoyer Club to allow them to continue using the facility.
Emery’s will do the catering.
There will be no change in the hours of operation.
Speaking in favor is Maurice Paquette, 156 Blackburn Street, Pawtucket, RI, President of LeFoyer.
Mr. Paquette states that a meeting of LeFoyer Club Members was held on December 29, 1993, authorizing the sale of the building and the transfer of the license, which was approved overwhelmingly.
LeFoyer will stay at its present location and will be a first class operation.

THE CLERK IS INSTRUCTED TO ISSUE A SUMMONS TO THE OFFICERS OF THE HAPPY HOUR CLUB, 404 BENEFIT STREET, TO APPEAR ON WEDNESDAY, FEBRUARY 9, 1994, TO ANSWER CHARGES OF VIOLATIONS WHICH OCCURRED AT THE HAPPY HOUR CLUB LEADING TO THE ARREST OF AN OFFICER OF THE CLUB, WHICH WAS A RESULT OF AN INVESTIGATION BY THE RHODE ISLAND STATE POLICE REGARDING ILLEGAL GAMBLING AT THIS ESTABLISHMENT.
