A regular session of the Pawtucket Board of License Commissioners is held Wednesday, October 20, 1993, at eight one o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present except Councilors Kinder and Rabbitt; President Barry presides.
The reading of the Records of October 6, 1993, is dispensed with and the Records are approved as prepared by the Clerk.
FORMAL HEARING:

THE CHAIR RECOGNIZES COUNCILOR DOYLE.
Upon Motion made by Councilor Doyle, seconded by Councilor Vieira, the Formal Hearing on the Class A Liquor License of Antonio Fernandes d/b/a Fernando’s Liquors, 558 Broadway is recessed until the requested information regarding a birth certificate of the minor is available.
Memo from Police Chief Richard E. DeLyon regarding Dazzle’s Restaurant & Lounge, 602 Smithfield Ave. (Violation - Serving patrons after the legal closing time) is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR VIEIRA.
With majority consent of the Council, the following Motion made by Councilor Vieira, seconded by Councilor Calista is passed on a unanimous voice vote:
The Clerk is instructed to issue a Summons to the owners of Class B (Victualer) liquor license in the name of C.C. & D.D. Inc., d/b/a Dazzle’s, 602 Smithfield Avenue, to appear at a Formal Hearing on Wednesday, November 10, 1993, to answer the charges of allegedly serving patrons after the legal closing time.
Communication from Christopher E. Fay, Esq., Assistant City Solicitor regarding the status of the Liquor License for the Lily Social Club, is READ AND ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILOR VIEIRA.
With majority consent of the Council, the following Motion made by Councilor Vieira, seconded by Councilor Calista, is passed on a unanimous voice vote:
The Clerk is instructed to send a communication to Jack Gannon, City Solicitor, requesting that he attend the next meeting of the Board of License commissioners to give a clarification on the Courts decision to allow the Lily Social Club the right to sell its liquor license. The Council’s confusion stems from the fact that it has been repeatedly told by the Liquor Control Administration that a license has no value and cannot be sold. Also, they do no understand how a revoked license can be sold as an asset.
THE FOLLOWING PETITION FOR LICENSE IS GRANTED ON A UNANIMOUS VOICE VOTE:

Pawtucket Arts Council, to sell alcoholic beverages at a Fund Raiser Comedy Show, Dinner/Dance at the Peerless Building, 175 Main Street, on Saturday, October 23, 1993, from 8 PM until 1 AM. LIC#40
THE CHAIR RECOGNIZES COUNCILOR CLEMENT.
With majority consent of the Council, the following Motion made by Councilor Clement, seconded by Councilors Moran and Calista, is passed on a unanimous voice vote:
The Clerk is instructed to send a communication to Kevin Shea, Executive Director, Pawtucket Redevelopment Agency, regarding the fund raiser scheduled to be held in the former Peerless Building. The Board wants to be sure that there is proper liability insurance to cover the Pawtucket Redevelopment Agency and the City.
Also, the Board would like to know if the Peerless Building is available to other community groups to hold similar types of functions. If it is, the Board would like to know what these groups must do in order to apply for the use of this building. A response is requested in time for the November 10, 1993, meeting of the Board of License Commissioners.
