A regular session of the Pawtucket Board of License Commissioners is held Wednesday, November 10, 1993, at seven thirty-two o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present except Council President Barry, Councilors Clement and Doyle; President Pro Tempore Vieira presides.

 

The reading of the Records of October 20, 1993, is dispensed with and the Records are approved as prepared by the Clerk.

The Clerk is instructed to send a communication to the Liquor Control Administrator regarding the Class B (Victualer) liquor license of Snickers Inc., d/b/a LaVault’s Restaurant, 55 Memorial Drive, Pawtucket. The Council would like to know what its obligation is as to the renewal of this license, as the Council has revoked the license and that decision has been stayed by Liquor Control. Specifically, should the Council act on this license now or should it wait until a decision is rendered from the Liquor Control Administration. Secondly, if the Board decides to deny the renewal of the liquor license, must it have another Hearing on the matter or can it stand on its decision that it made previously to revoke the license.

B.         One (1) police detail must be provided on the night (s) or day (s) of entertainment. If a police detail is not secured on a day or night of entertainment then the entertainment must be canceled by owner or someone responsible for the Dublin Inn.

3.         No motor cycles will be parked on the sidewalk on either Dean Street or Columbus Avenue.

4.         No outside drinking in fenced in area or entire parking lot at any time.

4.         In addition to the manager and /owner, a bartender shall be on duty during the hours of operation.

5.         The kitchen shall not be open unless a cook is on duty. The manager, owner, and/or bartender shall not do “double duty.”

6.         All disturbances, no matter how insignificant shall be reported to the police, IMMEDIATELY.

The Council reminds the applicant of its previous warning placed on the Liquor License resulting from a FORMAL HEARING which state that “STERNER ACTIONS AGAINST THIS LICENSE WILL BE TAKEN IMMEDIATELY IF THE ACTIVITIES WHICH CAUSED THE HEARING REOCCUR.”

1.         Violating Rhode Island Law of Selling Alcoholic Beverages to Minors.

Inc., d/b/a Dazzle’s 602 Smithfield Avenue is SUSPENDED for a period of 30 days beginning at Midnight on Friday, November 12, 1993, for the following reason:

 

1.         Violating Rhode Island Law of Serving Alcoholic Beverages after hours.

2.         Operating a neighborhood nuisance.

3.         Allowing illicit, improper, and unlawful behavior within the establishement.

 

ALSO, THE OWNERS ARE FINED $500 FOR SAID VIOLATIONS.
