A regular session of the Pawtucket Board of License Commissioners is held Wednesday, May 5, 1993, at seven thirty-eight o’clock p.m. in the City Council Chambers, City Hall, Pawtucket, RI. All the Members are present except Councilors Doyle, Moran, and Rabbitt; Chairman Barry presides.
The reading of the Records of April 21, 1993, is dispensed with and the Records are approved as prepared by the Clerk.

Mr. Fay requests that the Hearing be continued until May 19, 1993, to allow the State Police Officer involved in the case against LaVault’s the opportunity to appear and testify.

Upon Motion made by Councilor Rabbitt, seconded by Councilor Calista, the Formal Hearing regarding Snicker’s Inc., d/b/a LaVault’s Restaurant, 55 Memorial Drive is postponed until May 19, 1993.
The Clerk is instructed to contact Frank Rendine, Director Division of Zoning and Code Enforcement requesting an update on the zoning and code violations at LaVault’s Restaurant, both inside and outside of the building, in time for the May 19th Formal Hearing.
A Public Hearing is held on the following application for license advertised for this time:

El Castillo Restaurant Inc., 3 Garden Street (transfer from Beatrice A. Doran d/b/a Lou’s Club 43, 43 Broad St & 44 Summer Street) LIC #161
Speaking in favor and representing applicant is Attorney Maurice Caron, Cottage Street, Pawtucket, RI.
Also present is the applicant, Hugo Sepulveda, 23 Winthrop Street, Providence, RI.
Mr. Sepulveda states that he took over the business, previously Chicken Power, turning it into a family type restaurant. The establishment seats approximately 45-50 people, and is requesting approval of the liquor license in order that patrons may have a drink with their meals.
Upon questioning from Councilor Vieira, Mr. Sepulveda states that money was invested in the business to renovate and purchase needed equipment. He states that it will be very different than the type of bar previously at this location, it will be a family type restaurant.
He states that he is aware of problems in the past. He states that both he and his brother have experience in the restaurant and liquor business. The restaurant will be open from 11 a.m. until 10 p.m. They will provide a full menu, beginning with appetizers, soups, salads, main entrees and desserts.
Attorney Caron invites the Councilors to tour the facility.
Speaking in opposition is Mr. McGinney, a neighbor.
Mr. McGinney states that the previous owner was a big problem to the neighborhood and he does not want a liquor license back in the neighborhood.
There are no other speakers.
The Hearing is closed.
Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the application for transfer of El Castillo Restaurant Inc. 3 Garden Street (transfer from Beatrice A. Doran d/b/a Lou’s Club 43, 43 Broad St & 44 Summer Street) LIC #161 is LAID ON THE TABLE and Councilor Vieira will set up an appointment with the applicant to allow the City Council members and the residents of the neighborhood an opportunity to have a tour of the facility.
Liquor Control Administration submitting Order in the matter of the Lily Social Club’s request to reopen - REQUEST DENIED is READ AND ORDERED FILED.

Communication from Ralph Garner requesting an outdoor patio for the Class B (Victualer) Liquor License of Country Lounge Inc., d/b/a Tommy’s Lounge, 99 India Street.
THE CHAIR RECOGNIZES COUNCILOR RABBITT.
With majority consent of the Council, upon Motion made by Councilor Rabbitt, seconded by Councilor Calista, the request from Ralph Garner for an outdoor patio for the Class B (Victualer) Liquor License of Country Lounge Inc., d/b/a Tommy’s Lounge, 99 India Street is APPROVED on a unanimous voice vote. Mr. Garner is strongly urged to take measures to ensure that the patrons using this outside facility cooperate in keeping the area quiet and not disturbing to the neighbors.
Communication from Clube Social Portugues Inc., 131 School Street, requesting permission to erect an outside dance pavilion, (plans attached) is READ AND ORDERED FILED AND PERMISSION TO ERECT OUTSIDE DANCE PAVILION IS APPROVED on a unanimous voice vote.
Communication from Francis R. Murphy, Jr., President Maugus Corporation requesting permission to build an outdoor deck at the Ground Round at Two George Street, Pawtucket, RI, is READ AND ORDERED FILED AND PERMISSION TO BUILD AN OUTDOOR DECK IS APPROVED on a unanimous voice vote.
