February 24, 1993

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, February 24, 1993, at seven thirty-six o’clock p.m., at Jenks Junior High School, Media Center, 350 Division Street, Pawtucket, RI. All the members are present except Councilors Calista and Clement; Chairman Barry presides.

 

The reading of the records of February 10, 1993, is dispensed with and the Records are approved as prepared by the Clerk.

 

Communication from John B. Harwood, Attorney representing Elias Dernikos d/b/a City Line Pizza and Restaurant, 592-594 Pawtucket Avenue, requesting that the Formal Hearing scheduled for February 24, 1993, be rescheduled to March 24, 1993 is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILOR BRAY.

 

With majority consent of the Council, upon Motion made by Councilor Bray, seconded by Councilor Vieira, the request to reschedule the Formal Hearing of City Line Pizza and Restaurant until March 24, 1993, is APPROVED on a unanimous voice vote with the STIPULATION that a detail police officer be hired on Friday and Saturday evenings between the hours of 9:00 p.m. until 1:00 a.m. until the Formal Hearing is held on March 24th.

 

Copy of Summons to Elias Dernikos d/b/a City Line Pizza and Restaurant, 592-594 Pawtucket Avenue, requesting that he attend a Formal Hearing scheduled for February 24, 1993, is LAID ON THE TABLE UNTIL MARCH 24, 1993.

 

Copy of Summons to Dante Alighieri Social Club, 22 Hurley Avenue, requesting that the President attend a Formal Hearing scheduled for February 24, 1993 IS READ AND ORDERED FILED.

 

Communication from Richard E. DeLyon, Chief of Police, regarding an incident at the Dante Alighieri Social Club on Saturday, February 13, 1993 IS READ AND ORDERED FILED.

THE CHAIR RECOGNIZES COUNCILOR BRAY.

 

Upon Motion made by Councilor Bray, seconded by Councilor Vieira, and with the unanimous consent of the Council, the Class D (First Class) liquor license of Dante Alighiei Social Club, 22 Hurley Avenue, is SUSPENDED FOR A PERIOD OF FIVE (5) DAYS BEGINNING AT 12:01 A.M. FEBRUARY 25, 1993, FOR THE FOLLOWING REASONS:

 

1.         Violations of Class D Liquor License, specifically having a party, open to the public.

2.         Having live entertainment without a license.

3.         Disregarding the order of the Police to stop live entertainment at the party held on 1/23/93.

 

IT IS FURTHER ORDERED THAT A DETAIL POLICE OFFICER BE HIRED FOR FRIDAY AND SATURDAY EVENINGS BETWEEN THE HOURS OF 9:00 P.M. AND 1:00 A.M.

 

The Board further strongly urges that the licensee take whatever steps are necessary to work with the neighbors to solve the problems which currently exist with the operation of this club.

 

A Public Hearing is held on the following application for license advertised for this time:

Todd’s Pub Inc d/b/a Broadway Pub (transfer 100% Stockholders), 735 Broadway. LIC #160

 

Speaking in favor is Andrew Cagen, Attorney, 1165 Elmwood Avenue, Providence, RI, representing applicant.

 

Mary Todd, applicant, 1011 Bald Hill Road, Warwick, RI.

 

Mr. Cagen states that Mrs. Todd is the widow of the owner. He states that she has restaurant experience and that there will be no changes in the business.

 

There are no other speakers.

With majority consent of the Council, upon Motion made by Councilor Moran, seconded by Councilor Vieira, the following license is GRANTED on a unanimous voice vote:

Notice from the United States Bankruptcy Court for the District of Rhode Island, appointing Louis A. Geremia as Chapter 11 Trustee of the Lily Social Club, 158 South Bend Street, and Jan’s Place, 58 Middle Street is READ AND ORDERED FILED.

 

The following petition for license is GRANTED on a unanimous voice vote:

 

CLASS F (Beer & Wine)

 

St. Patrick’s Day Parade Committee, to sell beer & wine at a fund raiser dance to raise money for the parade at the Pawtucket Armory, Exchange Street, on Saturday, March 6, 1993, from 1 PM - 7 PM. LIC #26.

 

THE CHAIR RECOGNIZES COUNCILOR VIEIRA.

 

With majority consent of the Council, the following Motion made by Councilor Vieira, seconded by Councilor Kinder is passed on a unanimous voice vote:

 

The Clerk is instructed to send a communication to Michael Corso, officer of the Rhode Island Toreadors Junior Drum and Bugle Corps, requesting that he attend the next meeting of the Board on March 10, 1993, to discuss his recent application for license to sell alcoholic beverages at a fund raiser dance for the benefit of the Rhode Island Toreadors Junior Drum and Bugle Corps, which went before the Board on February 10, 1993.

 

THE CHAIR RECOGNIZES COUNCILOR RABBITT.

 

With majority consent of the Council, the following Motion made by Councilor Rabbitt, seconded by Councilor Kinder, is passed on a unanimous voice vote

 

The Clerk is instructed to notify Snicker’s Inc d/b/a LaVault’s Restaurant, 55 Memorial Drive, to appear at a Formal Hearing before the Board of License Commissioners on Wednesday, March 24, 1993, to answer the following charges:

 

1.         Drug related charges brought by the Rhode Island State Police on February 19, 1993, against an Officer of the Corporation.

2.         Recent conviction of said Officer on drug related charges.

3.         Zoning and Code Enforcement violations at the establishment.

 

Upon Motion made by Councilor Vieira, seconded by Councilor Kinder, the meeting is adjourned at eight thirty-four o’clock p.m.
