A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 7, 1993, at seven forty o’clock p.m., at Jenks Junior High School, Media Center, 350 Division Street, Pawtucket, RI. All the members are present except President Barry; Vice-Chairman Vieira presides.
The reading of the records of March 24, 1993, is dispensed with and the Records are approved as prepared by the Clerk.
Copy of Summons to Elias Dernikos d/b/a City Line Pizza and Restaurant, 592-594 Pawtucket Avenue, requesting that he attend a Formal Hearing re-scheduled for April 7, 1993 is READ AND ORDERED FILED.

Upon Motion made by Councilor Bray, seconded by Councilor Clement, and with the unanimous consent of the Council, the Class B (Victualer) liquor license of Elias Dernikos d/b/a City Line Pizza and Restaurant, 592-594 Pawtucket Avenue. is SUSPENDED FOR TEN DAYS BEGINNING AT 12:01 AM APRIL 12, 1993 FOR THE FOLLOWING REASONS on a ROLL CALL VOTE AS FOLLOWS:
Ayes - Vice Chairman Vieira, Councilors Bray, Calista, Clement, Doyle, Kinder, Moran, and Rabbitt.
Noes - 0.
FAILURE TO NOTIFY POLICE OF ALLEGED FELONIOUS ASSAULT.
THE CHAIR RECOGNIZES COUNCILOR BRAY.
With majority consent of the Council, the following Motion made by Councilor Bray seconded by Councilor Clement is passed on a unanimous voice vote:
The Clerk is instructed to send a communication to Richard E. DeLyon, Chief of Police requesting a report of any police activity at City Line Pizza and Restaurant over the past six weeks ending April 7, 1993.
Liquor Control Administration ORDER issuing a Stay in the matter of the Suspension of the CLASS B (Victualer) liquor license of D.V.K. Enterprises Inc., d/b/a Boomer’s Sports Bar and Comedy Club, 327 Barton Street, and setting date for hearing on May 14, 1993, at 9:30 a.m. is READ AND ORDERED FILED.
Communication from Paul L. Foster, Hearing Officer, Liquor Control Administration, regarding hearing date set for Monday, April 12, 1993, in the matter of the Lily Social Club is READ AND ORDERED FILED.
Communication from Mark S. Krieger, Attorney representing DVK Enterprises d/b/a Boomer’s, submitting for approval a change in officer of the Corporation is READ AND ORDERED FILED AND OFFICER IS APPROVED PENDING BCI CLEARANCE.
INFORMAL HEARING REGARDING THE FOLLOWING IS TAKEN UP:

Present at the Hearing are:

Ryder Kenney, Attorney representing Mr. Corso, 188 Benefit Street, Providence, RI.
Upon questioning by Councilor Vieira, Mr. Corso states that a “one day license” was revoked because what he thought was to be a relatively small party turned into one with 1000 people. He states it was a fundraiser for the Toreadors and that Mr. Luis Santine contacted him to ask to run a small party in conjunction with the Toreadors as a fundraiser with about 150 people at the most. Mr. Corso states he was not informed about a cultural dance. Mr. Corso further states that he believes that he was deceived and he would not have allowed the party if he had known that 1000 people were expected.
Mr. Corso states that Mr. Santine was considering litigation against the City and asked if he (Mr. Corso) would join in, to which he stated “no.”
Mr. Corso further states that they are a 501-C-3 Non profit group and after questions from the Council states that he does not usually check backgrounds of people who wish to use the building, he takes them at their word.
There are no other speakers.

INFORMAL HEARING regarding the following license is taken up:
C.C. & D.D. Inc. d/b/a Dazzle’s, 602 Smithfield Avenue.
There are no persons appearing representing Dazzle’s.
THE CHAIR RECOGNIZES COUNCILOR CALISTA.
With majority consent of the Council, the following Motion made by Councilor Calista, seconded by Councilor Kinder, is passed on a unanimous voice vote:
The Clerk is instructed to issue a SUMMONS for a FORMAL HEARING to C.C. & D.D. Inc. d/b/a Dazzle’s, 602 Smithfield Avenue, to appear on Wednesday, April 21, 1993, to discuss recent police reports in which the establishment was in violation of the liquor laws by allegedly being open and/or serving patrons at 5:03 a.m. on March 8, 1993.
THE CHAIR RECOGNIZES COUNCILOR RABBITT.
With majority consent of the Council, the following Motion made by Councilor Rabbitt, seconded by Councilor Calista, is passed on a unanimous voice vote:
The Clerk is instructed to notify all parties involved with LaVault’s Restaurant, 55 Memorial Drive, that the Formal Hearing regarding this establishment is being rescheduled, per the request of Attorney Marty Marran, for Wednesday, May 5, 1993, at 7:30 p.m.
Upon Motion made by Councilor Calista, seconded by Councilor Kinder the meeting is adjourned at nine twenty o’clock p.m.
