A Special Session of the Pawtucket Board of License Commissioners is held Monday, September 30, 1991, at three thirty-eight o’clock p.m. All the members are present except Councilmembers Doyle, Robert Lynch, William Lynch and Rabbitt; Chairman Houle presides.
Communication from President Raymond W. Houle, Jr., calling a SPECIAL SESSION of the City Council for Monday, September 30, 1991, at 3:30 PM is READ AND ORDERED FILED.
A FORMAL HEARING REGARDING THE CLASS B (Victualer) LIQUOR LICENSE OF JUDGE KELLEY’S INC. D/B/A KELLEY’S CORNER PUB, 548 SMITHFIELD AVENUE, is taken up:
Representing the City of Pawtucket is Patrick Quinlan, Attorney.
Also representing the Police Department is Commander Richard DeLyon.
Representing Judge Kelley’s Inc., is Attorney William Burke.
Also in attendance are William R. Kelley, Jr., 10 Maureen Drive, Smithfield, RI, and Kurt Carney, 29 Varnum Avenue, Pawtucket, RI.

THE CHAIR RECOGNIZES COUNCILMAN VIEIRA.
Upon Motion made by Councilman Vieira, seconded by Councilman Barry, the CLASS B Victualer liquor license of Judge Kelley’s Inc. d/b/a Kelley’s Corner Pub, 548 Smithfield Avenue is PERMANENTLY REVOKED on a roll call vote, as follows:
Ayes - President Houle, Councilmembers Barry, Calista, Kinder, and Vieira.
Noes - 0.
REVOCATION TO COMMENCE AT 5:00 O’CLOCK P.M. ON SEPTEMBER 30, 1991, ON THE FOLLOWING GROUNDS:
1. Failure to maintain control of the establishment and its patrons, death resulting.
2. A documented history of serious and life threatening assaults on and about the premises.
3. Failure to maintain security in and around the establishment and not complying with State “Minor Book” requirements.
4. Persistent and repeated complaints of disturbances requiring police intervention.
5. Establishment poses a clear and present danger to the Community.
Summons to William R. Kelley Jr., President, Judge Kelley’s Inc d/b/a Kelley’s Corner Pub, 548 Smithfield Avenue, to appear at a Formal Hearing scheduled for Monday, September 30, 1991, at 3:30 PM is ORDERED FILED.
THE CHAIR RECOGNIZES COUNCILMAN VIEIRA.
With majority consent of the Council, the following Motion made by Councilman Vieira, seconded by Councilman Barry, is passed on a unanimous voice vote:
The Clerk is instructed to notify Robert J. Derrick, President of Derrick’s Food and Spirits Inc., 242 Middle Street to appear at a Formal Hearing scheduled for Thursday, October 3, 1991, at 3:30 p.m. to answer charges of alleged criminal activities at the establishment and other action caused by said establishment resulting in danger to the public; and to show cause why said Class B (Victualer) liquor license should not be revoked.
Upon Motion made by Councilman Barry, seconded by Councilman Kinder the meeting is adjourned at four thirty-seven o’clock p.m.
