A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 11, 1991, at eight sixteen o’clock p.m. All the members are present except Councilman William Lynch and Chairman Houle presides.
The reading the records of August 21, 1991, is dispensed with and the records are approved as prepared by the Clerk.
The following matter was Laid on the Table at the meeting held August 21, 1991, and is again taken up:
Communication from Frederick A. Duffy owner of FAD Food Enterprises, Ltd. d/b/a Dublin Inn. 214-216 Columbus Avenue request for reconsideration of the existing stipulations on the Liquor License.
THE CHAIR RECOGNIZES COUNCILMAN RABBITT.
With majority consent of the Council, Motion made by Councilman Rabbitt, seconded by Councilmen Kinder and Calista the request to reconsider existing stipulations on the Class B Victualer Liquor License of FAD Food Enterprises, Ltd. d/b/a Dublin Inn. 214-216 Columbus Avenue is approved on a unanimous voice vote as follows:
1. 30 day trial license on entertainment will be reviewed November 1st, 1991.
A. Doors are kept closed at all times.
B. One (1) police detail must be provided on the night(s) or day(s) of entertainment. If a detail is not secured on a day or night of entertainment then the entertainment must be canceled by owner or someone responsible for the Dublin Inn.
2. Doors will be closed at all times.
3. No motor cycles will be parked on the sidewalk on either Dean St. & Columbus Ave.
4. No outside drinking in fenced in area or entire parking lot at any time.
5. Evacuate patrons in parking lot at closing time - No Loitering.
6. Each morning or afternoon, the owner or manager are to walk around the establishment and surrounding homes and pick up beer bottles.
7. No more than 76 people in building, per order of Fire Chief.
8. No longer will there be any Wednesday specials or any other specials on any nights, per State Law Chapter 7, Section 3-7-26.
Communication from Dante Alighieri Social Club of 22 Hurley Avenue submitting a new list of officers for approval IS TAKEN UP:

With majority consent of the Council, upon Motion made by Councilman Barry, seconded by Councilmen Kinder and Vieira the communication from the Dante Alighieri Social Club of 22 Hurley Avenue submitting a new list of officers for approval IS TAKEN UNDER ADVISEMENT ON A UNANIMOUS VOICE VOTE UNTIL SUCH TIME AS A NEIGHBORHOOD MEETING IS HELD WITH THE NEW OFFICERS TO DISCUSS FUTURE PLANS FOR THE CLUB.
COUNCILMAN WILLIAM LYNCH ARRIVES AT EIGHT TWENTY-ONE P.M.
Claim of McLaughlin & Moran, Inc., against the transfer of Class B Victualer liquor license of Beijing Garden Restaurant, Inc. of 270 Dexter St. to C & Z Restaurant Corp. d/b/a/ Golden China Restaurant in the amount of $64.10 IS READ AND ORDERED FILED.
A Public Hearing is held on the following application for license advertised for this time:
CLASS B (VICTUALER)
C & Z Restaurant Corp. d/b/a Golden China Restaurant, 270 Dexter St. LIC#147
(Transfer from Beijing Garden Restaurant, Inc.)
Speaking in favor is Attorney Gordon Lee, 1070 Kingstown Road, Peacedale, Rhode Island, representing the applicant.
Mr. Lee states that the restaurant is a family operation, and the hours are 11:00 AM to 11:00 PM.
Mr. Lee also states that there is a small bar that only seats 4 or 5 people.
Speaking in favor is Attorney Christopher Stowe, 300 Centerville Road, Warwick, representing the seller.
Mr. Stowe states that there has been no problems with prostitution on the premises.
Mr. Stowe states that the transfer is contingent on the signing of a purchase and sales agreement.
There are no speakers in opposition.

Upon Motion made by Councilman Vieira, seconded by Councilman Kinder, the following application for license is GRANTED on a unamious voice vote PENDING THE CLEARANCE OF ALL OUTSTANDING CLAIMS.

Claim of Arcaro, Belilove, and Kolodney, Attorneys at Law against the transfer of Class B Victualer liquor license of Braxton’s Inc. of 505-507 Armistice Blvd. to Upper Crust Pizza, Inc., in the total amount of $252.08 IS READ AND ORDERED FILED.

Speaking in favor is Attorney David Graham, 28 Spring Street.
Mr. Graham states that Upper Crust Pizza, Inc., is a family style restaurant, the hours of operations will be 11:00 AM to 11:00 PM on Monday through Friday; Saturday and Sunday 7:00 AM to 11:00 PM.
Mr. Graham states that there is no bar area, and the maximun capacity is 127. There are no expansion plans and the basement will not be used for or by the customers.
Mr. Graham also states that the new owners have 28 years of experience in the restaurant business, and they are not part of a food chain.
There are no speakers in opposition.

The Clerk is instructed to send a communication to Francisco Rocchio, President of Arcadia Enterprises Inc. d/b/a Galateo of 210 Dexter Street requesting that he attend a pre-council session scheduled for Wednesday, September 25, 1991, at 7:30 P.M. to give Mr. Roccio the opportunity to show cause why his license should not be revoked.
