January 23, 1991.

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 23, 1991, at seven thirty-four o’clock p.m. All the members are present except Councilmen Kinder and Rabbitt; and Chairman Houle presides.

 

The reading of the records of January 9, 1991, is dispensed with and the records are approved as prepared by the Clerk.

 

THE MATTER OF THE SUSPENSION OF THE FOLLOWING LICENSE WAS LAID ON THE TABLE AT THE MEETING HELD JANUARY 9, 1991, AND IS AGAIN TAKEN UP:

 

CLASS D (First Class)

COUNCILMAN KINDER ARRIVES AT SEVEN FORTY-THREE O’CLOCK PM.

 

THE CHAIR RECOGNIZES COUNCILMAN BARRY.

 

With majority consent of the Council, upon Motion made by Councilman Barry seconded by Councilmen Vieira and Robert Lynch, the following license is REVOKED on the following grounds, on a roll call vote, as follows:

 

Ayes - President Houle, Councilmen Barry, Calista, Doyle, Kinder, Robert Lynch, and Vieira.

 

Noes - 0.

 

Abstain - Councilman William Lynch

 

CLASS D (First Class)

 

Dante Alighieri Social Club, 22 Hurley Avenue

 

REVOKED ON THE FOLLOWING GROUNDS:

 

1.         Despite ample time provided to the attorney for Mr. Vitali, he has failed to prove or even produce a shred of evidence that the establishment is being operated in accordance with the laws of Rhode Island governing the use of a Class “D” license.

 

2.         That the actual ownership of the establishment is Mr. Albert Vitali, Sr., and a substitute name was used possibly to conceal from the Board of License Commissioners a criminal record.

 

3.         There is a repeated record of mismanagement of the establishment which has caused a danger to the neighborhood in which the building is located. It is apparent through years of abuse that the actual owner or names provided the City Council are unable to maintain order in the neighborhood and are unable to properly operate any liquor establishment, but especially a Class “D”.

 

Communication from William J. Burke, Attorney representing the Dante Alighieri Social Club, submitting certain materials as requested at the formal hearing held on January 9, 1991 is READ AND ORDERED FILED.

 

COUNCILMAN RABBITT ARRIVES AT SEVEN FORTY-SIX O’CLOCK PM.

 

Communication from Richard E. DeLyon, Commander of Police, regarding Duffin’s Pub is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILMAN RABBITT.

 

With majority consent of the Council, the following Motion made by Councilman Rabbitt seconded by Councilman Calista, is passed on a unanimous voice vote:

 

The Clerk is instructed to notify Commander Richard DeLyon to contact the owner of Duffin’s Pub, notifying him that the police detail can be reduced to Friday evenings only.

 

Claim of Arcaro, Belilove, and Kolodney, Attorneys at Law, objecting to the transfer of Class C liquor license of Broadway Pub, Inc., 735 Broadway to Todd’s Pub Inc., in the amount of $1,002.10 is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILMAN BARRY.

 

With majority consent of the Council, Councilman Barry introduces the following communications:

 

Claim of Arcaro, Belilove & Kolodney, Attorneys at Law, objecting to the transfer of Class C liquor license of Broadway Pub Inc., 735 Broadway to Todd’s Pub Inc., in the amount of $388.11.

 

Claim of Wayne Distributing Co., objecting to the transfer of Class C liquor license of Broadway Pub Inc., 735 Broadway to Todd’s Pub Inc., in the amount of $704.90.

 

Communication from Wayne Distributing Co., releasing its objection to the transfer of Class C liquor license of Broadway Pub Inc., 735 Broadway to Todd’s Pub Inc.

 

Claim of McLaughlin & Moran Inc., objecting to the transfer of Class C liquor license of Broadway Pub Inc., 735 Broadway to Todd’s Pub Inc., in the amount of $1,559.00.

 

Communication from McLaughlin & Moran, Inc., releasing its objection to the transfer of Class C liquor license of Broadway Pub Inc., 735 Broadway to Todd’s Pub Inc.

 

Upon Motion made by Councilman Barry seconded by Councilman Kinder, the following communications are READ AND ORDERED FILED:

A Public Hearing is held on the following application for license advertised for this time:

Speaking in favor is Andrew Cagan, Attorney representing applicant, 1165 Elmwood Ave., Providence, RI.

 

Mr. Cagan states that applicant, Kenneth Todd, has worked in taverns for ten years.

 

Also present is Kenneth Todd, applicant, 135 Bald Hill Trailer Park, Warwick, RI.

 

Mr. Todd states that there will be no changes in the type of business being presently operated. He further states that he ran a pub for six years and owned a pub for three years. He will continue the same hours of operation as now exists.

 

There are no other speakers.

 

The hearing is closed.

 

Upon Motion made by Councilman Barry, seconded by Councilman Kinder, the following application is approved on a unanimous voice vote:
