A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 9, 1991, at seven thirty-five o’clock p.m. All the members are present except Councilmen Barry, Robert Lynch William Lynch, and Rabbitt; and Chairman Houle presides.
The reading of the records of December 19, 1990, is dispensed with and the records are approved as prepared by the Clerk.

With majority consent of the Council, the Matter of the Suspension of the Class D Liquor License of the Dante Alighieri Social Club, 22 Hurley Avenue is LAID ON THE TABLE, pending the receipt of the following information, on a unanimous voice vote:
1. Information to prove that the Dante Alighieri Club is a non-profit organization, in conformance with a Class D liquor license issued by the State of Rhode Island.
2. A Copy of the by-laws which state the purpose of the non-profit organization.
3. The books of the organization determining the funds and how the funds are channeled through other non-profit organizations.
4 A copy of the latest enrollment, a copy of the membership cards issued, and the minutes of the last annual meeting with any other details including votes and attendance; and any non-profit status from the I.R.S.
Communication from Gerald S. Goldstein, Liquor Control Administrator submitting Decision in the matter of Class A liquor license transfer of Patricia Musone d/b/a National Liquors to Angell Liquors Inc., to GRANT license transfer is READ AND ORDERED FILED.

Speaking in opposition is Samuel Hanna, 549 Broadway, Pawtucket.
Mr. Hanna submits the following:
Petition of neighbors objecting to transfer of liquor license of Ronald Loparto to corner of Broadway and Margaret Street (17 Signatures)
Plat Map with colored in area representing the percentage of objecting property owners.
Mr. Hanna states that there is not enough parking space on this lot as it is an undersized lot.
Mr. Hanna further states that this area on Broadway is already saturated with liquor establishments. He also states that there are a number of schools and churches in the immediate area.
Speaking in opposition is Samuel Hanna, Jr., 12 Conca St., No. Providence, RI.
Mr. Hanna states that he agrees with what his father just stated. He states that Ziggy’s license at the location where it is presently is not being used very much. However, moving it to a new location and new owner will create more traffic in the area and more congestion. He goes on to state that this was the previous home of the Gaiety Lounge and there were many problems in those years. A business of this type does not serve the neighborhood. Mr. Hanna further states that a 20,000 square foot parcel of land is too small to put a building with adequate parking. The people in the neighborhood do not want another bar in this section of the neighborhood as indicated by the signed petition opposing this transfer.
Speaking in opposition is Glen Surkont, 530 Broadway, owner of Surkont’s Cafe.
Mr. Surkont states that this transfer will put another bar in this section of Broadway within 300 feet of his bar. The patrons of the proposed license will use his parking lot, creating problems there. The location of the existing Ziggy’s license is in a more business area, the proposed new location is more residential.
Speaking in opposition is Richard Allen, 24 Norborough Rd., No. Attleboro, MA.
Mr. Norborough states that he is the manager of the Twin City Credit Union across the street from the proposed location. He requests that the transfer be denied because there are to many bars in this area.

THE CHAIR RECOGNIZES COUNCILMAN DOYLE.
With majority consent of the Council, Councilman Doyle states that based on the percentage of the property owners objecting, which is well over 50%, Rhode Island General Law Section 3-7-19 prohibits the issuance of a Class B liquor license when the greater part of the land owners within two hundred feet object. Based on this section of State Law and the testimony given at the public hearing, requests that this application for transfer be denied.
Upon Motion made by Councilman Doyle, seconded by Councilman Calista, based on Section 3-7-19 of the General Laws of the State of Rhode Island, “Objection by adjoining property owners” and the testimony given at the Public Hearing, the following application for license transfer is DENIED on a unanimous voice vote:

Councilman Calista refers to the communication from Patricia & Bruce Tillinghast.
Rev. Ferguson states that it is not the intent of the Church to run a bar. The facility is used for private functions, three to four months a year and the Church does not intend to change this type of operation.
A liquor license is needed in order to obtain insurance.

The Clerk is instructed to request George Karamanolis, President of Voutena Inc., d/b/a Constantine’s, 852-856 Newport Avenue to be present at a pre-council meeting on January 23, 1991, to discuss the continuing problems neighbors are having with this businesses’ parking lot.
