A regular session of the Pawtucket Board of License Commissioners is held Wednesday, September 5, 1990, at eight thirty-eight o’clock p.m. All the members are present except Councilmen Barry and Kinder; Chairman Houle presides.
The reading of the records of August 22, 1990, is dispensed with and the records are approved as prepared by the Clerk.
FORMAL HEARING REGARDING CLASS A - Portugalia Liquor Co., Inc., 225-227 Barton Street is taken up:
Olimpio Menezes, 225 Barton Street, Pawtucket, Rhode Island, License Holder.
Councilman Vieira asks Mr. Menezes if he is aware that on July 25, 1990, an employee, Mr. Jose Silva was arrested for selling liquor to minors. Mr. Menezes responded yes.
Councilman Vieira asks if Mr. Menezes was also aware of that another employee, Maria Faria, was also arrested for selling to minors on that date. Mr. Menezes says yes.
Councilman Vieira asks where Mr. Menezes was at the time. Mr. Menezes states he was on vacation.
Councilman Vieira states that at a pre-council hearing August 22, 1990, the neighbors complained that the Liquor store was used as a hangout for prostitutes, Councilman Vieira asks if that was so. Mr. Menezes responded that some do buy things in his store, but then they leave.
Councilman Vieira states that he believes that liquor store adds to the problem on the Barton Street area and asks Mr. Menezes if he has done anything to improve the situation in the neighborhood. Mr. Menezes responded that he has. He states that he has been carding patrons and not serving minors.
Councilman Vieira asks if Mr. Silva or Mrs. Faria are still working for Mr. Menezes, Mr. Menezes responded that they are not.
Councilman Vieira states that he drove by the establishment last week and saw Mr. Silva there. Mr. Menezes says that Mr. Silva does things for him there and he hangsout there. Mr. Vieira states that he is still working there and Mr. Manezes says he is not. He hangsout there but he does not get paid.
Councilman Vieira asks Mr. Menezes if he has any thing else to say in his defense, Mr. Menezes responded that he has been in that location for seven years, and there have been no other complaints previous to the one that was mentioned today.

Upon Motion made by Councilman Vieira, seconded by Councilman Robert Lynch, based on the testimony given, the Class A Liquor License of Portugalia Liquor Co., Inc., 225-227 Barton Street, is SUSPENDED FOR THIRTY (30) DAYS on a roll call vote as follows:
Ayes - President Houle, Councilman Calista, Doyle, Robert Lynch, William Lynch, Rabbitt and Vieira.
Noes - 0
CLASS A LIQUOR LICENSE OF PORTUGALIA LIQUOR CO., INC., 225-227 BARTON STREET IS SUSPENDED FOR THIRTY (30) DAYS BASED ON THE FOLLOWING:
1. NEIGHBORHOOD NUISANCE
2. SELLING ALCOHOL TO MINORS
3. TWO VIOLATIONS IN ONE DAY
Affidavit of David Bibby owner of the property located at 176 Meadow Street, stating that the Monitor Club is no longer at that address is READ AND ORDERED FILED.

Upon Motion made by Councilman Calista, seconded by Councilman Rabbitt, the following license is granted WITH THE FOLLOWING STIPULATIONS on a unanimous voice vote:
