Pawtucket Board of License Commissioners.

June 6, 1990.

 

A regular session of the Pawtucket Board of License Commissioners is held Wednesday, June 6, 1990, at nine seventeen o’clock p.m. All the members are present and Chairman Houle presides.

 

The reading of the records of May 23, 1990, is dispensed with and the records are approved as prepared by the Clerk.

 

A Public Hearing is held on the following application for license advertised for this time:

 

CLASS A

 

Angell Liquors Inc d/b/a National Liquors (transfer from Patricia Musone d/b/a National Liquors) 1516 Newport Avenue. LIC #148

 

Speaking in favor are Joseph and Patricia Musone, applicants, 6 Conduit Street, Providence, RI.

 

The applicants state that they are putting the business into a corporation; it will be the same owners and the same operation. The reason for incorporating is for purposes of liability and it is a better way to operate a business.

 

Speaking in opposition is Christine McBurney, Attorney, 100 Cottage Street, Pawtucket, RI.

 

Ms. McBurney states that she is representing the Estate of Kerry Vincent, a minor, who was killed in 1983, as a result of purchasing alcoholic beverages, along with other minors, from Joseph Musone. The Case went to Trial and the Estate was awarded $500,000; the decision was overturned in Supreme Court and a new Trial is set for sometime in the fall of 1990. The Musone’s had no insurance at the time of the incident and Ms. McBurney fears that incorporating will prevent a fair settlement. Ms. McBurney states that she believes the reason for incorporating is to insulate the Musone’s from any liability.

COUNCILMAN WILLIAM LYNCH STATES THAT HE DOES NOT BELIEVE THERE ARE ANY GROUNDS TO DENY THE TRANSFER.

 

Upon Motion made by Councilman Kinder, seconded by Councilman Barry, the following application for license transfer is LAID ON THE TABLE ON A ROLL CALL VOTE, AS FOLLOWS:

 

AYES - President Houle, Councilmembers Barry, Doyle, Kinder, William Lynch, Rabbitt, and Vieira.

 

NOES - Councilman Robert Lynch

 

ABSTAIN - Councilman Calista.

THE CLERK IS INSTRUCTED TO REQUEST A LEGAL OPINION REGARDING THIS TRANSFER; I.E., DOES THE COUNCIL HAVE THE RIGHT OR ARE THERE ANY GROUNDS ON WHICH THE BOARD CAN REFUSE THE TRANSFER BASED ON A PENDING LAWSUIT OF THIS TYPE.

 

A RESPONSE IS REQUESTED IN TIME FOR THE JUNE 20TH MEETING.

 

A Public Hearing is held on the following application for license advertised for this time, and no person or persons appearing to object thereto, is GRANTED on a unanimous voice vote:

 

CLASS B (LIMITED)

 

Margaret Dakake d/b/a Liberty Lunch (transfer from Saterios Gannites d/b/a Liberty Lunch) 732 Central Avenue. LIC #147

 

Upon Motion made by Councilman Kinder, seconded by Councilman Barry, the meeting is adjourned at nine thirty o’clock p.m.
