A regular session of the Pawtucket Board of License Commissioners is held Wednesday, July 11, 1990, at nine six o’clock p.m. All the members are present and Chairman Houle presides.
The reading of the records of June 20, 1990, is dispensed with and the records are approved as prepared by the Clerk.
FORMAL HEARING REGARDING THE FOLLOWING LIQUOR ESTABLISHMENT IS TAKEN UP:
CLASS B (Victualer)
Duffin’s Pub Inc., 215 Division Street.
Speaking against is Anthony J. Lanni, 24 Brewster Street.
Mr. Lanni states that he has lived in the neighborhood for the past twenty-five years. The Handrigan’s ran the pub twenty-five years ago an there were no problems. The L’Houlier’s bought the establishment and the problem started after the building was rebuilt due to a fire. The address says 215 Division Street on the license but the door is now on Brewster Street. There is insufficient parking (only enough for eight cars.)
Timothy Holloran, 128 Meadow Street.
Mr. Holloran states that there is ongoing problems. There are safety problems with racing cars causing accidents, drunk drivers. There is broken glass and cans littering neighborhood.
Gary Phillips, 128 Meadow Street.
Mr. Phillips states that the community standards have decreased. Children are confronted with the negative situations. They are picking up bad language and children of patrons wander unsupervised. There are parking problems and he recommends parking permits for residents.
Lorraine Josof, 17 Brewster Street.
Ms. Josof states that there is parking problems and broken bottles. There is loud noise that continues until the morning and it has reduced the living standards in the area.
Anthony Lanni, Jr., 18 Brewster Street.
Mr. Lanni states that there is noise problems in the parking lot late at night and patrons urinate in the parking lot.
Representative Mabel Anderson, 26 South Street.
Representative Anderson supports all previous speakers and wants past violations at the pub checked. She states that the elderly in the neighborhood have a right to a peaceful existence.
Speaking on behalf of the applicant is Attorney William Burke, 75 Park Place, Pawtucket, RI. Attorney Burke introduces John Duffin, President of Duffin’s Pub.
Mr. Burke states that Mr. Duffin cannot control what patrons do prior to arriving. He states that people have a right to park on a public street. Mr. Duffin can put security in the lot to control the problems.
Councilman Barry states that he has experienced several problems at the pub and that the police have been to the pub four hours and twenty-seven minutes over this year and ninety-eight minutes since July 1, 1990. He further states that in May, 1987 the doors had been ordered closed at all times and this has not been done in four to five weeks and Duffin’s has been ordered to have security between the hours of 10 pm - 2 am on Friday and Saturday nights five different times at six weeks each.
John Duffin, III, 114 Margaret Street.
Mr. Duffin states that there has been an officer on duty between 9:30 pm and 1:30 am every Friday except one or two nights when he did not show up.
John Duffin, Jr., states he has been there every night since July 4 and will be there every night to supervise outside. He admits that the problems are his fault and he states that he has raised the prices and eliminated pitchers of beer to curb the problems.

Upon Motion made by Councilman Barry, seconded by Councilman Kinder, the following STIPULATIONS ARE PLACED ON THE CLASS B (VICTUALER) LIQUOR LICENSE OF DUFFIN’S PUB INC., 215 DIVISION STREET:
1. Doors closed at all times
2. Special Duty Officer or Private Security Officer approved by the Public Safety Director on Thursday, Friday, and Saturday evenings between 10 pm - 1:30 am for six weeks in parking lot.

A Public Hearing is held on the following application for license advertised for this time:

Bino’s Liquors Inc., d/b/a Bino’s International Wine and Spirits, 50 Ann Mary Street, Unit C7a
(transfer from Glag Inc d/b/a Lipet’s Liquors, 473 Central Avenue.) LIC #150
Speaking in favor is Attorney Allan Barnes, 192 Chandler Avenue. Mr. Barnes states that the current license is not active but the license is alive and was renewed in December by the City Council.
Mr. Barnes introduces Albino DosSantos, 32 Angelo Avenue, North Providence. Mr. DosSantos states that it will be a family run business with four employees including himself, his mother and father and a friend. The hours of operation will be from 8 am - 10 pm November 1 - May 31; and 8 am - 11 pm June 1 - October 31. He has had six years retail experience but not liquor experience. The location is near the Papa Gino’s Restaurant and he is familiar with the liquor laws.
Speaking in opposition is Robert Brady, Attorney, 164 Airport Road, Warwick, Rhode Island.
Mr. Brady represents four Class A Retailers and the R I Liquor Store Association.
Mr. Brady cites Rhode Island General Laws 3-5-16.1, “Revocation of Abandoned Licenses” and states that he believes that this establishment does not meet any of the stated reasons in the law for an extension on his license. He feels that being out of business for eight months is too long, and requests a “Show Cause” hearing as to why this license should not be declared “Abandoned”.

Ayes - President Houle, Councilmembers Barry, Calista, Doyle, Kinder, William Lynch, Rabbitt and Vieira.

Speaking in favor is Attorney Raymond Cooney, 1060 Park Avenue, Cranston, RI, representing applicant.
Mr. Cooney states that this is a small establishment which hold approximately 15-20 people. There have not been any problems in the past and will continue to run the same type of business.
