A regular session of the Pawtucket Board of License Commissioners is held Wednesday, January 10, 1990, at six fourteen o’clock p.m. All the members are present except Councilmen Doyle, Robert Lynch, and Rabbitt.
COUNCILMAN DOYLE ARRIVES AT SEVEN TWO O’CLOCK P.M.
FORMAL HEARING REGARDING THE FOLLOWING LIQUOR ESTABLISHMENT IS TAKEN UP:

THE CHAIR RECOGNIZES COUNCILMAN CALISTA.
With majority consent of the Council, upon Motion made by Councilman Calista, seconded by Councilman Vieira, the Formal Hearing for Ride’s Restaurant is continued pending receipt of a letter from Mr. Oster, Attorney for Ride’s Restaurant, stating intention of the license holder to sell Ride’s Restaurant, and not to open during the sale period is passed on a unanimous voice vote. Subpoena Duces Tecum shall continue in full force and effect until January 24, 1990.

The reading of the records of December 20, 1989, and January 1, 1990, is dispensed with and the records are approved as prepared by the Clerk.
The election of the Chairman of the Pawtucket Board of License Commissioners is now taken up.
Upon Motion made by Councilman Calista, seconded by Councilman Barry, Councilman Raymond W. Houle, Jr., is elected CHAIRMAN of the Pawtucket Board of License Commissioners on the following roll call vote:
Ayes - Councilmembers Barry, Calista, Doyle, Houle, Kinder, William Lynch and Vieira.
Noes - 0
COUNCILMAN RAYMOND W. HOULE, JR., IS ELECTED CHAIRMAN OF THE PAWTUCKET BOARD OF LICENSE COMMISSIONERS.
COUNCILMAN ROBERT W. LYNCH ARRIVES AT SEVEN THIRTY-THREE O’CLOCK P.M.
Upon Motion made by Councilman Calista, seconded by Councilman Kinder, Councilman John J. Barry, III is elected VICE CHAIRMAN of the Pawtucket Board of License Commissioners on the following roll call vote:
Ayes - Chairman Houle, Councilmembers Barry, Calista, Doyle, Kinder, Robert Lynch, William Lynch, and Vieira.

Communication from Fred E. Joslyn, Jr., City Solicitor regarding Ride’s Restaurant is READ AND ORDERED FILED.
Claim of Arcaro, Belilove and Kolodney, Attorneys at Law, objecting to the transfer of Class A liquor license of Lopes Liquors Inc., 139 Benefit St., to Delia Mello in the amount of $242.59 is READ AND ORDERED FILED.

A Public Hearing is held on the following application for license advertised for this time:

Dilia Mello d/b/a Lopes Liquors (transfer from Lopes Liquors Inc) 139 Benefit Street. LIC #138
Speaking in favor is Attorney, Charles Rogers, Jr., 25 South Angell Street, Providence, RI, representing the applicant.
Mr. Rogers apologizes for the delay in the transfer. The license was revoked in 1985, upheld by Liquor Control Administrator; however, a restraining order was issued by Superior Court. Mr. Rogers states that this license is transferable and there have been no violations since then. Mr. Rogers has explained all the rules to Mrs. Mello regarding minors and intoxicants. Mrs. Mello purchased the license without any bank financing. She has no liquor store experience, her husband will be involved. It is stated that Mrs. Mello is Mr. Lopes’ sister. Mr. Lopes will not be involved in the store after the transition period.
Councilman Doyle states that he fears this is a paper transfer only. Mr. Lopes states that he wants to get out of the liquor business.
There are no other speakers.
The Hearing is closed.
Upon Motion made by Councilman Barry, seconded by Councilman Kinder, to approve the following application for license is DENIED on a roll call vote, as follows:
Ayes - President Houle and Councilman Kinder.
Noes - Councilmembers Barry, Doyle, Robert Lynch, William Lynch, and Vieira.
