December 5, 1990.
A regular session of the Pawtucket Board of License Commissioners is held Wednesday, December 5, 1990, at seven thirty-two o’clock p.m. All the members are present except Councilman Rabbitt, and Chairman Houle presides.
The reading of the records of November 21, 1990, is dispensed with and the records are approved as prepared by the Clerk.
FORMAL HEARING REGARDING THE FOLLOWING LIQUOR LICENSE IS TAKEN UP:
CLASS B (VICTUALER) - Arcadia Enterprises Inc. d/b/a Galateo, 210 Dexter Street.
First speaker is Sergeant Seabeck. Sgt. Seabeck states that he was assigned by the detail officer to supervise the detail of Arcadia Enterprises. He stated that most functions at the Club Metro were held by a Church group from Central Falls, and Mr. Rocchio was in attendance. He stated that there were minor complaints to police detail at those events. Since July 1990, Mr. Rocchio has not been running the Club, it has been run by the Baptista brothers, Julio and Ernesto, the brother of Tui Baptista who ran the L.A. Bar. Sgr. Seabeck stated that there was a fight outside the bar one night; it was a major altercation and an arrest was made.
On November 9, 1990, there was an under 21 party at the Metro. Sgt. Seabeck stated that there was no police detail hired and he heard the next day that several fights broke out in and outside the establishment.
On November 11, 1990, Sgt. Seabeck heard that there were several disturbances, and again there were no police details hired for that evening.
Councilman Rabbitt arrives at 7:40 p.m.
Sgt. Seabeck states that occasionally there has been drinking by underaged people in the bar, but they were not served by the bartender, they were given the drinks by other patrons.
Sgt. Seabeck states that there are usually officers hired on weekends and states that there are definitely more problems now under the new management.
Next speaker is Virginia Miranda, 19 Dexter Court, Pawtucket.
Ms. Miranda states that her testimony is the same as Sgt. Seabeck. She also states that one night there was a car in front of her house which tried to run down people. It took one half hour for the police to clear it up. There have been many fights and she is aware that there were numbchucks used by the combatants at one fight.
Next speaker is William Murray, 74 Olive Street, Pawtucket.
Mr. Murray states that there were no problems at the establishment when Mr. Rocchio ran it, but there are many now that he doesn’t.
Next speaker is Representative Elaine Coderre,
Ms. Coderre states that she has worked on this problem with Jack Carney and Bill Vieira. There were many problems when this was run as L. A. Bar and now again that the Baptista Brothers are running it. These residents have put up with this problem a long time, and they should have some peace. They have formed a neighborhood group to try to work with the people and more restrictions on this license are needed to help these people.
Next speaker is Richard Pollitt, 55 Masthead Dr., Warwick, RI.
Mr. Pollitt is the attorney representing Mr. Rocchio.
Mr. Pollitt states that Mr. Rocchio is not in attendance. He does not know why. He spoke to Mr. Rocchio at about 5:30 p.m. and was told that he would be there. Mr. Pollitt states that Mr. Rocchio has had health problems but wants to run the establishment again himself. He says if he is unable to do so, he will try to sell the license. Mr. Rocchio would like approximately one month to correct the problems and is willing to come back to the Council for further determination. Mr. Pollitt states that Mr. Rocchio is unhappy with the present managers and that there were no problems when Mr. Rocchio ran it.
Councilman Vieira states that he is concerned that Mr. Rocchio did not see fit to appear at the hearing and further states that he was told by neighbors that Tui Baptista, who ran the L. A. Bar, has keys to the place and frequents the establishment.

THE FOLLOWING APPLICATION FOR LICENSE WAS LAID ON THE TABLE AT THE MEETING HELD NOVEMBER 21, 1990, AND FOR THE PERIOD BEGINNING DECEMBER 2, 1990, AND ENDING DECEMBER 1, 1991, AND IS GRANTED on a unanimous voice vote:
CLASS B (Victualer)
Arcadia Enterprises Inc 210 Dexter St. LIC #129
THE CHAIR RECOGNIZES COUNCILMAN VIEIRA.
With majority consent of the Council, Councilman Vieira requests that the Class B Victualer liquor license of Arcadia Enterprises Inc, 210 Dexter Street be suspended until licensee can show to the Board of License Commissioners that he (Mr. Rocchio) can run the establishment himself or hire adequate management, based on the following reasons:
1. Neighborhood Disturbances
2. Fighting in and around establishment
3. Uncontrolled noise
4. Drinking of Alcoholic Beverages by under-aged persons
Upon Motion made by Councilman Vieira, seconded by Councilman Calista the following Class B Victualer liquor license of Arcadia Enterprises Inc, 210 Dexter Street is suspended until licensee can show to the Board of License Commissioners that he (Mr. Rocchio) can run the establishment himself or hire adequate management, based on the following reasons on a unanimous voice vote:
1. Neighborhood Disturbances
2. Fighting in and around establishment
3. Uncontrolled noise
4. Drinking of Alcoholic Beverages by under-aged persons
THE FOLLOWING APPLICATION FOR LICENSE WAS LAID ON THE TABLE AT THE MEETING HELD NOVEMBER 21, 1990, FOR THE PERIOD BEGINNING DECEMBER 2, 1990, AND ENDING DECEMBER 1, 1991, AND IS GRANTED on a unanimous voice vote with all previous stipulations to remain in full force and with the addition of adding a detailed police officer on Thursday evenings for a period of three months.
CLASS D (First Class)

A Public Hearing is held on the following application advertised for this time:
CLASS A
Countryside Liquors Inc (transfer 100% of Stockholders), 553-555 Armistice Blvd. LIC #137
Speaking in favor is Joseph Musone, 382 Angel Rd., Lincoln, RI.
Mr. Musone states that he has been in the liquor business for nine years, has had no violations in the last seven years. He states that his wife owns National Liquors. He states that this transfer is a complete stock transfer and that he will run that business and also hire a manager.
There are no speakers in opposition.
The hearing is closed.
Upon Motion made by Councilman Rabbitt seconded by Councilmen Kinder and Doyle, the following application for license is GRANTED.
Councilman Barry abstains.
President Houle votes in opposition.

A Public Hearing is held on the following application advertised for this time, and no person or persons appearing to object thereto, is granted on a unanimous voice vote:

THE CHAIR RECOGNIZES COUNCILMAN BARRY.
With majority consent of the Council, the following Motion made by Councilman Barry, seconded by Councilmen Vieira and Kinder, is passed on a unanimous voice vote to SUSPEND THE CLASS D LIQUOR LICENSE OF THE DANTE ALIGHIERI SOCIAL CLUB, 22 HURLEY AVENUE COMMENCING AT 12:00 O’CLOCK NOON ON THURSDAY DECEMBER 6, 1990, UNTIL A FORMAL HEARING SCHEDULED FOR WEDNESDAY, JANUARY 9, 1991, FOR THE FOLLOWING REASONS:
1. Numerous neighborhood disturbances
2. Fighting inside and outside your establishment
3. Gunfire at the Establishment
