A regular session of the Pawtucket Board of License Commissioners is held Wednesday, April 11, 1990, at eight seven o’clock p.m. All the members are present and Chairman Houle presides.

 

The reading of the records of March 21, 1990, is dispensed with and the records are approved as prepared by the Clerk.

 

Claim of James T. Higgins, Attorney at Law, against the transfer of Class B (Victualer) liquor license of Bodner Inc. d/b/a Lee’s Pub, 605-607 Broadway to Harry O’s Place Inc., in the total amount of $600.00 IS READ AND ORDERED FILED.

 

Claim of William R. Kelley, Jr., against the transfer of Class B (Victualer) liquor license of Bodner Inc. d/b/a Lee’s Pub, 605-607 Broadway to Harry O’s Place Inc., in the total amount of $20,915.41 IS READ AND ORDERED FILED.

 

Claim of Eastern Utilities Inc., against the transfer of Class B (Victualer) liquor license of Bodner Inc. d/b/a Lee’s Pub, 605-607 Broadway to Harry O’s Place Inc., in the total amount of $547.19 IS READ AND ORDERED FILED.

THE CHAIR RECOGNIZES COUNCILMAN BARRY.

 

With majority consent of the Council, Councilman Barry introduces the following claims:

 

Claim of Wayne Distributing Company, against the transfer of Class B (Victualer) liquor license of Bodner Inc. d/b/a Lee’s Pub, 605-607 Broadway to Harry O’s Place Inc., in the total amount of $577.50.

 

Claim of Providence-Newport Distributing Co., against the transfer of Class B (Victualer) liquor license of Bodner Inc. d/b/a Lee’s Pub, 605-607 Broadway to Harry O’s Place Inc., in the total amount of $109.47.

 

Claim of Gaschen Law Offices representing D.B. Amusement & Vending Inc., against the transfer of Class B (Victualer) liquor license of Bodner Inc. d/b/a Lee’s Pub, 605-607 Broadway to Harry O’s Place Inc., in the total amount of $1150.00.

 

Claim of Maurice Caron, Jr., Attorney at Law, against the transfer of Class B (Victualer) liquor license of Bodner Inc. d/b/a Lee’s Pub, 605-607 Broadway to Harry O’s Place Inc., in the total amount of $5,979.75.

 

Upon Motion made by Councilman Barry, seconded by Councilman Kinder, the following Claims are READ AND ORDERED FILED:

A Public Hearing is held on the following application for license advertised for this time:

 

CLASS B (Victualer)

 

Harry O’s Place Inc d/b/a Harry O’s Place (transfer from Bodner Inc d/b/a Lee’s Pub) 605-607 Broadway LIC #144

 

Speaking in favor is Marty Marran, Attorney, 255 Main Street, Pawtucket, RI, representing Bodner Inc.

 

William Burke, Attorney, 75 Park Place, Pawtucket, RI, representing Harry O’s Place Inc.

 

Mr. Burke states that Mr. Ogden, is the sole stockholder and principal in the Corporation.

 

Councilman Doyle asks Mr. Ogden if he is aware that there have been problems in this area and why does he (Mr. Ogden) want to get into a problem area.

 

Mr. Ogden states that he wants to be in his own business and feels that he could be good for the area. He wants to run a quiet business; previously worked as a bar operator for the Happy Hour Club. He will continue the same hours and the only form of entertainment will be a jukebox. Mr. Ogden will be there 90% of the time.

 

Councilman Calista states that two items need attention; the dumpster and parking.

 

Mr. Ogden states that the dumpster will be picked up weekly and he will post signs asking patrons not to park in neighbors driveways.

 

Attorney Marran disputes some of the claims; i.e., claim of Gaschen Law Offices representing D.B. Amusement & Vending Inc.; and claim of Maurice Caron, Jr., Attorney representing George F. Thurber. Mr. Marran states that under Section 3-5-19 of the General Laws of the State of Rhode Island, these claims are not properly before the Council.

 

President Houle takes note of Mr. Marran’s dispute, but no other action will be taken.

 

Speaking in opposition is Felix Zydallis, D. & B. Amusement & Vending Inc., states that his claim is properly before the Council.

 

There are no other speakers.

 

The hearing is closed.

 

Upon Motion made by Councilman Barry, seconded by Councilmen Calista and Kinder, the following application for license is GRANTED on a unanimous voice vote PENDING THE SETTLEMENT OF ALL OUTSTANDING CLAIMS:

Harry O’s Place Inc d/b/a Harry O’s Place (transfer from Bodner Inc d/b/a Lee’s Pub) 605-607 Broadway LIC #144

 

The following petition for license is GRANTED on a unanimous voice vote:

 

CLASS F (Beer & Wine)

 

GTE Employees Association to serve beer & wine at Annual Family Picnic at Slater Park on Saturday, July 28, 1990, 10 AM-6 PM. LIC#7

 

THE CHAIR RECOGNIZES COUNCILMAN DOYLE.

 

With majority consent of the Council, Councilman Doyle states the Polish Home on Central Avenue is released from its arrangement with the police department for a police detail. The owners and neighbors have met to discuss the problems and are agreeable with the present situation.

 

Upon Motion made by Councilman Barry, seconded by Councilman Kinder, the meeting is adjourned at eight thirty-five o’clock p.m.

 

A special session of the Pawtucket Board of License Commissioners is held Thursday, April 19, 1990, at five ter. o’clock p.m. All the members are present and Chairman Houle presides.

 

Communication from President of the City Council Raymond W. Houle, Jr., calling a Special Session of the City Council for Thursday, April 19. 1990 is READ AND ORDERED FILED.

 

The following application for license is GRANTED on a unanimous voice vote:

 

CLASS F (BEER & WINE)

 

St. Raphael Ladies Auxiliary to serve beer & wine at fund raiser-Las Vegas Night - at Fr. Barry Center on Saturday, April 12, 1990, from 7 PM - 12 Midnight. LIC #8.

 

Upon Motion made by Councilman Barry, seconded by Councilman Kinder, the meeting is adjourned at five twelve o’clock p.m.
