A regular session of the Pawtucket City Council is held Wednesday, June 9, 2010, at 7:20 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

Petition for Auto Repair Shop by MNM Towing & Recovery LLC d/b/a MNM Auto Sales and Recovery, 231 Japonica Street, Tax Assessors Plat 8 Lot 411, to keep a shop for the purpose of repairing automobiles, which was advertised for a hearing at this time, it taken up:
CURRENT STIPULATIONS ON SECOND HAND SHOP LICENSE:
1. No Dumpster pick-up before 7:00 am
2. Designate 2 spots in the parking lot for customer parking.
COUNCILOR BARRY RETURNS TO THE CHAMBERS AT 8:15 P.M.
Speaking in favor are the applicants, Milton Giard and Cory McNulty.
Mr. Giard states that the business currently does auto sales and towing and is looking for a repair license to provide minor repairs to the vehicles that they sell or service their towing equipment.
Councilor Wildenhain asks what the hours of operation will be.
Mr. McNulty states the hours will be Monday through Friday from 9:00 a.m. to 6:00 p.m., and half day on Saturday.
Mr. Giard states the business is located in a residential area and that they are friendly with the neighbors.
Councilor Wildenhain reviews the following stipulations that he will place on the license.
ADDITIONAL STIPULATIONS:
Mr. Giard and Mr. McNulty agree to these stipulations being added as a condition of their license.
The next speaker is Attorney Michael Horan, representing the owners of the building next door.
Mr. Horan states that his client has an 8,000,000.00 investment to protect. He states that they have had open communication with the applicants.
The next speaker is Edward Dunphy, 238 Japonica Street, Pawtucket, RI.
Mr. Dunphy states that a business has been in that building since 1973, and he has no problems or issues with the applicants.

Speaking on behalf of the applicants Ivonne Rosario and Juan Rosario is Attorney Michael Horan.
Mr. Horan states that the business has been vacant for several years.
Ms. Rosario is a student at Bryant College, she will be running the business, and her cousin Juan Rosario is the mechanic who will repair the cars.
President Kinch states that neighbors are concerned about car storage.
Ms. Rosario states there is room for storage in the back and sides of the business.
Also speaking is Dennis Tracey, owner of the property.
He states that there is room for 3 to 4 cars in the front; 6 cars on the side; and 6 to 8 cars in the back.
President Kinch states that there needs to be some structure and a plan.
Mr. Horan states that the second hand shop application is for used parts for said repair only.
President Kinch states that he would like to do a site tour.
Mr. Horan states that he will prepare a site plan and schedule a tour prior to the next meeting.

The proposed rate of $18.62 per $1,000 assessed valuation of residential real estate against the prior year rate of $17.78 produced a $0.84 increase on residential taxes. The amended rate of $17.78 against the prior year rate of $17.78 represents a $0 increase on residential taxes. Therefore, the above amendments represent a $0.84 decrease on residential taxes to the proposed budget.
The proposed rate of $25.70 per $1,000 assessed valuation of commercial real estate against the prior year rate of $23.88 produced a $1.82 increase on commercial taxes. The amended rate of $24.54 against the prior year rate of $23.88 represents a $0.66 increase on commercial taxes. Therefore, the above amendments represent a $1.16 decrease on commercial taxes to the proposed budget.
