A special session of the Pawtucket City Council is held Tuesday, April 12, 2005, at 7:31 p.m. in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI. 

 

Present – President Grebien, Councilors Barry, Bray, Carr, Clemente, Hodge, Moran, Vitali and Wildenhain

 

Absent – 0

 

President Grebien presides.

 

591      Communication from Donald R. Grebien, President, Pawtucket City Council to the Honorable Members of the Pawtucket City Council, calling a Special Session to be held on Tuesday, April 12, 2005, at 7:30 p.m., is READ AND ORDERED FILED.

 

THE CHAIR RECOGNIZES COUNCILOR CARR.

 

With majority consent of the Council, Councilor Carr introduces the following communication:

 

Communication from Alfred Carpionato, President, Carpionato Properties, Inc., to Councilman Robert E. Carr, Chairman, City Property Committee.  (Amendments to PDA for Division Street Hotel)

 

Upon motion made by Councilor Carr, seconded by Councilor Hodge, the following communication is READ AND ORDERED FILED:

 

644      Communication from Alfred Carpionato, President, Carpionato Properties, Inc., to Councilman Robert E. Carr, Chairman, City Property Committee.  (Amendments to PDA for Division Street Hotel)

 

THE FOLLOWING RESOLUTION SUBMITTED BY THE CITY PROPERTY COMMITTEE FOR APPROVAL IS TAKEN UP:

 

RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE THE ATTACHED AMENDMENTS TO THE PROPERTY DISPOSITION AGREEMENT WITH DIVISION STREET HOTEL LLC.

 

THE CHAIR RECOGNIZES COUNCILOR HODGE.

 

With majority consent of the Council, Councilor Hodge introduces the following amendment to the resolution entitled “Resolution Authorizing the Mayor to Execute the Attached Amendments to the Property Disposition Agreement with Division Street Hotel LLC”:

 

Delete the following:

 

BE IT FURTHER RESOLVED, that this Resolution supercedes and replaces any and all prior resolutions concerning the disposition of the General Motors Property on Division Street. 

 

Upon motion made by Councilor Hodge, seconded by Councilor Clemente, the following amendment to the resolution entitled “Resolution Authorizing the Mayor to Execute the Attached Amendments to the Property Disposition Agreement with Division Street Hotel LLC” is APPROVED on a roll call vote, as follows:

 

AYES – President Grebien, Councilors Barry, Bray, Carr, Clemente, Hodge, Moran, Vitali, and Wildenhain.

 

NOES - 0.

 

Delete the following:

 

BE IT FURTHER RESOLVED, that this Resolution supercedes and replaces any and all prior resolutions concerning the disposition of the General Motors Property on Division Street. 

 

THE CHAIR RECOGNIZES COUNCILOR BARRY.

 

Upon motion made by Councilor Barry, seconded by Councilor Hodge, the motion for the following resolution to be LAID ON THE TABLE is DEFEATED on a roll call vote, as follows:

 

AYES – Councilors Barry, Bray, and Hodge.

 

NOES - President Grebien, Councilors Carr, Clemente, Moran, Vitali, and Wildenhain.

 

RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE THE ATTACHED AMENDMENTS TO THE PROPERTY DISPOSITION AGREEMENT WITH DIVISION STREET HOTEL LLC, AS AMENDED.

 

THE CHAIR RECOGNIZES COUNCILOR HODGE.

 

With majority consent of the Council, Councilor Hodge introduces the following amendment to the resolution entitled “Resolution Authorizing the Mayor to Execute the Attached Amendments to the Property Disposition Agreement with Division Street Hotel LLC, as Amended”:

 

Add the following:

 

If substantial construction has not begun six months from the date of the transfer of the property this contract will be null & void and all property will revert back to the City.

 

Upon motion made by Councilor Hodge, seconded by Councilor Barry, the following amendment to the resolution entitled “Resolution Authorizing the Mayor to Execute the Attached Amendments to the Property Disposition Agreement with Division Street Hotel LLC, as Amended” is DEFEATED on a roll call vote, as follows:

 

AYES – Councilors Barry, Bray, Hodge, and Moran.

 

NOES - President Grebien, Councilors Carr, Clemente, Vitali, and Wildenhain.

 

Add the following:

With majority consent of the Council, Councilor Hodge introduces the following:

Communication from Pamela M. Marchand, P.E., Chief Engineer, Pawtucket Water Supply Board, to Mayor James E. Doyle, and Members of the Pawtucket City Council.  (Rate Filing for Calendar 2006)

 

Communication from Joseph A. Keough, Jr., Esq. to John T. Gannon, Esq., Assistant City Solicitor, Central Falls (Sale of Central Falls Water Distribution System)

 

Upon motion made by Councilor Hodge, seconded by Councilor Moran, the following are READ AND ORDERED FILED:
