City Council, May 7, 2003
A regular session of the Pawtucket City Council is held Wednesday, May 7, 2003, at 7:05 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present –President Barry, Councilors Bray, Carr, Clemente, Grebien, Hodge, Hoyas, Moran, and Wildenhain.
Absent – 0
President Barry presides.
The reading of the records of April 23, 2003, is dispensed with and the records are APPROVED as prepared by the Clerk.
Upon motion made by Councilor Bray, seconded by Councilor Hodge, the *Consent Agenda is APPROVED, on a unanimous voice vote.

THE FOLLOWING LICENSE WAS LAID ON THE TABLE ON MARCH 19, 2003, APRIL 9, 2003, AND APRIL 23, 2003, IS AGAIN TAKEN UP AND IS APPROVED ON A UNANIMOUS VOICE VOTE:
Petition for Auto Repair Shop License by MTC Lighting, LLC., 41 Mendon Avenue, Tax Assessors Plat 18 Lot 980, to keep a shop for the purpose of repairing automobiles LIC#30299 which was advertised for a hearing at this time is taken up:
Speaking in favor is Michael Chaves, 95 Nye Street, Pawtucket, RI.
Mr. Chaves states that he is the owner of MTC Lighting. He states he is not in the business of fixing other peoples cars. He and his partner are car enthusiasts and each own three cars and those are the only cars being worked on at this facility. He understands that he does not need a license to work on his own car.
His business is an after market product for lighting on high-end automobiles. He does not operate an auto repair shop business.
Mr. Chaves states that Ronald Travers, Director, Zoning & Code Enforcement, was called to investigate a complaint of repairing cars; however, he was working on his own car. Mr. Travers told him to apply for an auto repair shop license. Mr. Chaves has been cited in Municipal Court for operating an auto repair shop business without a license. The matter has been continued until May 12, 2003.
Councilor Wildenhain states that he was told by neighbors that work is being conducted on cars and he has serious concerns with the number of auto repair shop licenses in this vicinity.
Councilor Wildenhain states that there are 5 auto repair shop businesses in this area.
Speaking in opposition is Gary Reis, 19 Mendon Avenue, Pawtucket, RI.
Mr. Reis has many concerns and opposes any business operated by MTC Lighting as well as by Mr. Chaves.
Mr. Reis cites many violations caused by Mr. Chaves and the people hanging around his business. He has supporting documents regarding the violations. He states the police are frequently called.
He states allowing this type of business will be a menace to the community and he is afraid someone will get hurt.
Speaking in opposition is Alan Perry, 50 Alden Street, Pawtucket, RI.
Mr. Perry states that he owns the adjacent property. He has had to replace 8 windows which were broken caused by MTC Lighting customers driving cars and making donuts in the snow, which kicked up rocks.
Speaking in opposition is Carl Archambeault, 71 Alden Street, Pawtucket, RI.
Mr. Archambeault owns property in the immediate area and states he has seen cars backing out fast and is afraid someone is going to get hurt.
He states that there is nitrous oxide on the property.
He states it is a nice neighborhood now, and wants it to stay that way.
Speaking in opposition is Tom McCaughey, owner of the property at 41 Mendon Avenue, Pawtucket, RI.
Mr. McCaughey states that he joins with the neighbors in opposition to this license. He has concerns with the liability insurance on this property and for all the reasons sited by the neighbors. He has information that the liability insurance has been cancelled.
Michael Chaves states that his insurance has never been cancelled. The nitrous oxide containers are empty and are on the premises as decorative bottles.
President Barry asks if Mr. Chaves took care of the damage his business caused to someone else’s property.
Mr. Chaves states no, that he never broke any windows.

THE CHAIR RECOGNIZES COUNCILOR WILDENHAIN.
Upon motion made by Councilor Wildenhain, seconded by Councilor Grebien, the following petition for license is DENIED based on the testimony provided at the Public Hearing on a unanimous voice vote:

Interpreting for Mr. Rodrigues is Mario Hernandez, 149 Butler Ave., Central Falls, RI.
Mr. Rodrigues is asking for a license to repair cars.
Council President Barry asks if Mr. Rodrigues has any experience.
Mr. Rodrigues states that he owns an auto repair shop business in Central Falls at 1063 Lonsdale Avenue.
This business will consist of oil changes, tire work, transmission work, and general repair.
President Barry states that the previous owner was renting parking spaces to the employees of Memorial Hospital and asks if Mr. Rodrigues is aware of this.
Mr. Rodrigues states he is not aware of this.
Upon questioning from President Barry, Mr. Rodrigues states that he will employ 2 people at this location, himself and his brother. There are 2 repair bays and he hopes to repair 5 cars daily. There will be no gasoline sales.
President Barry states that if this license is approved it will be stipulated that a limit of 3 cars will be allowed to be stored outside over night and all must be registered. The hours of operation will be 8 a.m.-6 p.m., M-F; 8 a.m.-3 p.m. -Saturdays.
Upon questioning from Councilor Bray, Mr. Rodrigues states that he will keep the Central Falls location open and Mr. Hernandez will manage that facility.
The next speaker is Louis Soares, 18 Chestnut Street, Pawtucket, RI.
Mr. Soares is concerned with unregistered vehicles on the lots of auto repair shop businesses as well as debris, tires, and oil disposal. Mr. Soares is concerned with the number of vehicles that will be stored at this location.

The Clerk is instructed to forward to the Ordinance Committee all pertinent Ordinances regulating auto repair shops storage of unregistered vehicles on the grounds of an auto repair shop license holder, and all Ordinances regarding overnight parking on the grounds of an auto repair shop.
The Ordinance Committee is requested to report back by July 1, 2003.
Petition for Auto Repair Shop and Second Hand Shop Licenses (Class B Parts Only) by Victor Rendon d/b/a Victor Auto Repair, 282 East Avenue, Tax Assessors Plat 54 Lot 820, to keep a shop for the purpose of repairing automobiles and purchasing and selling second hand articles, specifically used auto parts for said repair LIC#30298 & 40316 which was advertised for a hearing at this time is taken up:
Speaking in favor is Victor Rendon, 39 Moore Street, Central Falls, RI.
Interpreter for Mr. Rendon is Jose Lopes, 358 Cowden St, Central Falls, RI.
Mr. Rendon states that his hours of operation will be 8:00 a.m.-6:00 p.m., Monday-Friday; 8:00 a.m.-2:00 p.m., Saturdays.
Upon questioning from President Barry, Mr. Rendon replies that he has not been working at this location.
President Barry states that there has never been an auto repair shop business at this location. President Barry states that the Division of Zoning & Code Enforcement has concerns as listed in a communication, which will be introduced following the hearing. This matter will be referred to the Legal Department.
The communication states that this property is in disrepair and questions if this location is properly zoned for this type of business.
President Barry states that no action will be taken until this matter is clarified by the Legal Department.
Councilor Hodge asks if there is access to the property from East Avenue.
Mr. Rendon replies that the business will be operated on the James Street side of the property.
The next speaker is William Decelles, 10 Randall Street, Pawtucket, RI.
Mr. Decelles states that there is a garage behind the building which holds 5-7 cars and the lot could hold up to 25 cars.

Mrs. Cohen states that this is a side business catering to working women. She will be selling quality used clothing.
Hours of operation will be Monday-Saturday 8 a.m.-4 p.m.
She will extend the business hours if the business warrants it.
Mrs. Cohen states that a friend will work with her to run the store. Everything will be kept inside the building.
Speaking in opposition is Melanie Tatro, 76 Benefit Street, Pawtucket, RI.
Ms. Tatro lives across the street from this business and is concerned about the hours of operation. She states that people come in and out at night. There is debris in the parking lot and she does not want donation bins in the parking lot.
Ms. Tatro states that there was a shooting there sometime ago and is concerned with who goes into this building. This business is next to the Lafayette Social Club.
Speaking in opposition is Andrew Lesieur, 76 Benefit Street, Pawtucket, RI.
Mr. Lesieur states that he does not have an issue with a used clothing store. He is afraid that the business location will not be policed based on past experience. He states many cars are using the parking lot and he requests that the lot be for only the customers of Mrs. Cohen’s store. He also states that he does not want to see this property subdivided for other uses.

Travers, Director, Zoning and Code Enforcement, asking to inspect the property located at 75 Benefit Street and is further requested that Mr. Travers contact the owner of this property regarding the number of automobiles, not associated with any business at this location, be allowed to park on this lot, and to determine if there are any future plans to subdivide the rest of the property.
