City Council, March 19, 2003
A regular session of the Pawtucket City Council is held Wednesday, March 19, 2003, at 7:00 p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present –President Barry, Councilors Bray, Carr, Clemente, Hodge, and Moran.
Absent – Councilors Grebien, Hoyas, and Wildenhain.
President Barry presides.
The reading of the records of March 5, 2003, is dispensed with and the records are APPROVED as prepared by the Clerk.
Upon motion made by Councilor Bray, seconded by Councilor Hodge, the *Consent Agenda is APPROVED, on a unanimous voice vote.

COUNCILOR GREBIEN ARRIVES AT 7:05 P.M.
THE PUBLIC HEARING ON THE FOLLOWING LICENSES WAS CONTINUED AT THE MARCH 5, 2003, MEETING AND IS AGAIN TAKEN UP:
Speaking in favor is James Briden, Attorney, 150 Main Street, Pawtucket, representing Howard Baskin, applicant, 126 Illinois Street, Central Falls RI.
Mr. Briden states the applicant is requesting an Auto Repair Shop and Second Hand Shop License to sell used parts for said repair.
Mr. Briden states that the applicant has cleaned the property and removed the abandoned vehicles, as well as investing a substantial amount of money in this location.
Mr. Briden states that his client is aware that he must maintain the property and keep it clean to be consistent with the business climate of this location.
President Barry questions if the applicant has any previous experience.
Mr. Briden states that the applicant does not have experience, but his brother does.
President Barry states that he did have concerns about this license but these were taken care of. He is concerned about the upkeep of this property and will not tolerate messy conditions or unregistered cars and parts left outside.
President Barry is requesting that the hours be from 7:00 a.m. to 6:00 p.m. Monday-Friday and Saturday from 7:00 a.m. to 5:00 p.m.
President Barry asks how many people will be working in this business.
Mr. Baskin states there will be 3 people; his brother, father and himself.
Mr. Baskin states that he would like to service 5 autos per day.
President Barry will ask the Council to place a stipulation to limit only 3 registered cars on the outside lot, and no vehicles to be parked on Patt Street at any time.
The next speaker is Michael F. Horan, Attorney At Law, 393 Armistice Blvd, Pawtucket RI.
Mr. Horan is representing 407 Realty, who are the owners of the property adjacent to the business.
His clients have invested money in their business and want to be sure that the proper stipulations be placed on this license, in particular no outside storage of parts and vehicles on the property. Also, they do not want patrons to park on their property.
Mr. Horan states that his clients would like to see a buffer between the two properties. He also states that they are in agreement with the stipulation of the hours for this business.
President Barry asks the applicant if they would consider erecting a stockade fence within 3 months, blocking the rear of property from the professional building.

The first speaker is Al Thurber owner of Webster Place, 133 Webster Street. Mr. Thurber rents to Edward Chmielinski, applicant.
The applicant has been repairing automobiles for a number of years.
The next speaker is Emanuel Vieira, 140 Webster Street.
Mr. Vieira just bought his home, which is across the street from this business. He thought this business was going to be a self-storage business. He states that there are unregistered vehicles on the property and the business is open until 9:00 p.m.
Mr. Vieira states there were many motorcycles driving up and down the street and is requesting that no outside work or test-driving be allowed. Mr. Vieira also states that there are loud people on the property using foul language.

The Clerk is instructed to send a communication to Ronald F. Travers, Director, Zoning and Code Enforcement, requesting he inspect the property at 135 Webster Street for any violations, and to report the findings to either Councilor Grebien or Councilor Wildenhain in time for the next meeting scheduled for Wednesday, April 9, 2003.

Councilor Grebien is concerned with the dumpster and wants to make sure it is kept closed.
Councilor Grebien suggests the following stipulations:

2. No outside work.
3. No test driving.
4. Hours from 8:00 a.m. to 5:00 p.m. Monday-Friday
Saturday 8:00 a.m. to 2:00 p.m.
Councilor Grebien suggest that Mr. Carosi meet with the Police Chief to work out issues regarding this license.

1. No storage of bumpers outside of the existing building will be permitted, however the following exceptions will be allowed;
a) A maximum of 1-3 racks containing up to 225 bumpers may be placed next to the building in the area of the loading dock in the southwest corner of the building until such time as an additional storage until it is approved by the City Council and at which time these racks and bumpers would need to be enclosed in the new storage unit with absolutely no outside storage of bumpers thereafter.
b) All bumpers must be moved inside the building within 48 hours of delivery.
c) All bumpers currently stored outside must be removed within 30 days.
2. Deliveries of bumpers and trash removal will be allowed only during the hours of 7:00 a.m. to 7:00 p.m.
3. No work may be performed outside of the building with the exception of the unloading, sorting and loading of bumpers during normal business hours.
4. The grounds of the property will be cleaned and maintained and all debris from building renovations, surplus wood, rocks, and unused vehicles and trucks shall be removed within 30 days.
5. All emissions from the building must be property controlled in accordance with all applicable regulations.
6. No buildings or structures of any kind may be erected on the property without prior City Council approval.
