City Council, October 3, 2002
A special session of the Pawtucket City Council is held Thursday, October 3, 2002, at four fifty-two o’clock p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – President Barry, Councilors Carr, Clemente, Grebien, Hoyas, Moran and Wildenhain.
Absent –Councilors Bray and Hodge.
President Barry presides.
THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.
With majority consent of the Council, Councilor Clemente introduces the following communication:
Communication from His Honor Mayor James E. Doyle, to the Honorable Members of the Pawtucket City Council (Information on Earth Tech)
Upon motion made by Councilor Clemente, seconded by Councilor Wildenhain, the following communication is READ AND ORDERED FILED:
COUNCILOR HODGE ARRIVES AT FOUR FIFTY-FOUR O’CLOCK P.M.
THE CHAIR RECOGNIZES COUNCILOR CLEMENTE.
Upon motion made by Councilor Clemente, seconded by Councilor Wildenhain, the City Council enters into executive session at four fifty-four o’clock p.m., pursuant to Section 42-46-5 (A)(2) of the General Laws of Rhode Island regarding pending litigation on a roll call vote, as follows:
AYES - President Barry, Councilors Carr, Clemente, Grebien, Hodge, Hoyas, Moran, and Wildenhain.
NOES – 0
THE COUNCIL RETURNS TO OPEN SESSION AT FIVE FORTY-THREE O’CLOCK P.M.

With majority consent of the Council, the following motion made by Councilor Hoyas, seconded by Councilor Clemente, is PASSED on a roll call vote as follows:
AYES - President Barry, Councilors Carr, Clemente, Grebien, Hodge, Hoyas, Moran, and Wildenhain.
NOES - 0.
The Clerk is instructed to send a communication to Patrick J. Quinlan, Esq., requesting that he prepare a letter of inquiry into the financial condition of the parent companies of US Filter and Earthtech.

With majority consent of the Council, the following motion made by Councilor Hoyas, seconded by Councilor Hodge, is PASSED on a roll call vote as follows:

NOES - 0.
The Clerk is instructed to send a communication to Patrick J. Quinlan, Esq., requesting that he prepare a form of judgment addressing the ratification issue contained in Judge Darigan’s decision regarding the City of Pawtucket Water Treatment Plant.
