City Council, January 23, 2002
A regular session of the Pawtucket City Council is held Wednesday, January 23, 2002, at eight o’clock p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – President Barry, Councilors Carr, Hodge, Hoyas, and Wildenhain.
Absent – Councilors Bray, Clemente, Grebien, and Moran.
President Barry presides.
The reading of the records of January 9, 2002, is dispensed with and the records are APPROVED as prepared by the Clerk.
Upon motion made by Councilor Hodge, seconded by Councilor Wildenhain, the *Consent Agenda is APPROVED, on a unanimous voice vote.

THE CHAIR RECOGNIZES COUNCILOR HODGE.
With majority consent of the Council, the following motion made by Councilor Hodge, seconded by Councilor Wildenhain, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to His Honor, Mayor James E. Doyle, regarding his suggestion of forming a Tax Treaty Committee.
The Council is asking that he consider putting a representative from the City Council Ordinance and Finance Committees on this newly created tax treaty committee.
COUNCILOR CLEMENTE ARRIVES AT EIGHT EIGHT O’CLOCK P.M.
Petition for Auto Repair Shop and Second Hand Shop Licenses (Class A & B – Selling Used Automobiles and Parts) by Genaro M. Gomez and Maximo Campos d/b/a Car Master Auto Sales, 65 Patterson Avenue, Tax Assessors Plat 57, Lot 531, to keep a shop for the purpose of repairing automobiles and purchasing and selling second hand articles, specifically: used automobiles and parts, LIC# 30268 & 40279, which was advertised for a hearing at this time, is taken up:
Speaking in favor is Genaro Gomez, 20 Lawn Avenue, Pawtucket, RI.
Mr. Gomez states that he wants to sell cars in the lot and wants to repair cars coming from auction.
Mr. Gomez states that he will not repair cars from people only cars purchased from auction to sell. He will use 4 bays and the parking lot. He will have 2 employees working with him. He held a previous license at another location.
He has been operating at this location for a month until the police shut him down on Friday, January 18, 2002. He reopened on Tuesday, January 22, 2002, and the police shut him down once again, he misunderstood. He understands now that he cannot operate without a license.
Mr. Gomez states that his hours of operation will be 8:00 a.m. to 6:00 p.m. Monday through Friday, and 8:00 a.m. to 3:00 p.m. on Saturdays.
Speaking in opposition is Elizabeth Lebron, 52 Vale Street, Pawtucket, RI.
Ms. Lebron states that her lot abuts this building. She questions the amount of traffic in this area and is concerned for children playing. She questions the security for the building with the amount of cars stored on the lot. She also questions the environmental damage that could occur, and the method for waste disposal.
Ms. Lebron also states that she opposes the storage of cars on the sidewalk, and is concerned with the noise.
She feels that there are plenty of auto repair shops in the vicinity, and sees no need for an auto sales and repair shop in the neighborhood.
The next speaker in opposition is Rose Ginish, 45 Patterson Avenue, Pawtucket, RI.
Ms. Ginish states that she has the same concerns as the previous speaker. She states that the property looks like a dump now. A tow truck had to drop a car on the sidewalk because there was no other place to put it.
The next speaker in opposition is Leo Beauvais, 65 Utton Avenue, Pawtucket, RI.
Mr. Beauvais corrects the applicant. The business has been operating for three months not just one month, as the applicant has stated.
Mr. Beauvais states that he has lived at this location for 56 years and does not want to live in a junkyard. He asks the Council to help keep the neighborhood from deteriorating.
The next speaker is Louis Toval, 20 Lawn Avenue, Pawtucket, RI.
Mr. Toval states that he feels the applicant is just trying to make a living and the neighbors are only concerned with themselves.

The Clerk is instructed to send a communication to Ronald F. Travers, Director, Zoning and Code Enforcement, regarding an application being considered for an auto repair and second hand shop at 65 Patterson Avenue.
The Council has concerns with this location and is asking that the site be inspected and recommendations be offered on the following issues:
1. How many cars are allowed on the lot?
2. What recommendation does he have for waste disposal?
3. What recommendation does he have for the storage of autos and parts?
4. Any other recommendations that he can provide to the Council regarding environmental issues.
The Council is requesting a response by Monday, January 28, 2002.

Also speaking is Wayne Horne, 10 Brookfield Road, Riverside, RI.
Ms. Smith states that she wants to apologize to the neighborhood for putting cloths outside. She did not want to make any enemies and as soon as she was told she could not do this, she stopped.
Ms. Smith wants to operate this business. She is a retired corrections officer, and worked 35 years for the State of Rhode Island. Ms. Smith states that she was misinformed by the State of Rhode Island Division of Taxation. She was told she just needed the permit from the State.
Ms. Smith states she was unaware of any complaints. Her hours of operation will be Monday through Saturday from 9:00 a.m. until 9:00 p.m.
The next speaker is James Kareemo, 104 Power Road, Pawtucket, RI.
Mr. Kareemo states that he lives across the street from the business. He is very impressed with Wayne and Martha. Mr. Kareemo states that based on infomation he received, Ms. Smith was highly respected by her coworkers.
Speaking in opposition is Peter W. Scallin, 86 Power Road, Pawtucket RI.
Mr. Scallin states that he is not totally opposed but he has concerns with the way they are operating their business. Mr. Scallin states that they have been operating without a license since the fall. They have left a used display case outside, and there has been merchandise on the sidewalk, specifically: clothing.
Mr. Scallin states that he lives across the street from the business and it is a residential area. He feels the clothing displayed outside causes a messy atmosphere.
Councilor Clemente assures Mr. Scallin that there will be no clothing placed outside and only a limited amount of merchandise.
Mr. Scallin states that he wants the business to be neat and orderly.

The Clerk is instructed to send a communication to Commander Stephen P. Ormerod, asking that he enforce the no parking restriction on Charles Street in the City of Pawtucket.
Councilor Wildenhain states that Charles Street, which runs behind Our Lady of Consolation Church off of Sabin Street, has no parking on one side of the street. However, he observed that cars are parking on both sides of the street, which prohibits the City’s rubbish trucks from picking up trash, because there is no room for the trucks to drive down Charles Street.
