A regular session of the Pawtucket City Council is held Wednesday, November 7, 2001, at eight ten o’clock p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.

PREVIOUS STIPULATIONS –
1. Hours of operation shall be 8:00 am - 7:00 p.m. – Monday thru Friday, 8:00 a.m. to 12 noon on Saturdays.
2. Vehicles towed to business during operating hours only.

Councilor Clemente explains that he has requested the Legal Department to look into the issue of granting a conditional license, and if the conditions are not met can that license be immediately rescinded.
Councilor Clemente further explains the applicant for this license and his attorney are not present for this hearing because a legal opinion has not yet been provided on the issue of granting a conditional license.
Speaking in opposition is Nancy Witt, President, Pawtucket Citizens Development Corp., which neighbors this business.
Ms. Witt states that she is concerned with the condition of this business and the affect that it is having on the neighborhood.
The next speaker in opposition is George L. Kelley, III, Chief of Police.
Chief Kelley states that he has conducted a computer printout from January 1, 2001, and there has been 27 calls to this locations and 11 traffic problems. This is a huge number of calls for this location.

More specifically, the Council has an application for a second hand shop and auto repair shop filed by Mario Jimenez d/b/a Fonseca A/S, 263 Dexter Street, before them. If conditions are placed on the granting of these applications, and the conditions are not met, can the Council immediately remove the license to operate?
Councilor Clemente is requesting a response by Monday, November 12, 2001.

The Clerk is instructed to schedule a Ordinance Committee meeting for next week in which the Committee could draft a resolution in support of the Petition submitted regarding a Free Universal Breakfast Program for Pawtucket Schools.
The Clerk is further instructed to invite Mrs. Rogers to attend this meeting.
Councilor Wildenhain states that he is opposed to the idea of drafting a resolution in support of the a Free Universal Breakfast Program for Pawtucket Schools and as a member of the Ordinance Committee he is opposed to becoming involved with issues that should be addressed to the School Committee.

The Clerk is instructed to send a communication to Mrs. Jeanne Theberge informing her that her request for a zone change has been referred to the Planning Commission for an advisory opinion.
The Clerk is further instructed to send a communication to Michael D. Cassidy, Director, Planning and Redevelopment, requesting that both Councilor Moran and Mrs. Theberge be invited to attend any meetings that the Planning Commission may have on this issue.

The Clerk is instructed to send a communication to Lt. Rabbitt, requesting that he provide the Council with an update of the number of cars that pass through the Walcott and Enfield Street stop sign.
Councilor Wildenhain has received complaints from residents in that area who are requesting a police presence at that intersection because of the on going violations at that corner.

The Clerk is instructed to send a communication to Margaret M. Lynch-Gadaleta, City Solicitor, requesting a legal opinion of the feasibility of amending Section 116, Article IV, of the Code of Ordinances, 1996, regulating dogs and other animals, by adding language that would hold a landlord, be they live-in or absent, liable if a pit bull dog attacks another person.
This request is a result of recent dog attacks whereby absentee landlords allow their tenants to harbor pit bull dogs on their property, even though they are aware that these animals are not licensed, nor have the necessary liability insurance.
A response is requested in time for the November 20, 2001, meeting of the City Council.

The Clerk is instructed to send a communication to Craig Stenning, Executive Director, Division of Behavioral Health Care, Department of Mental Health, Retardation and Hospitals, regarding the property located at 278 High Street in Pawtucket.
The City Solicitor and Councilor Clemente met with representatives from the Department of Mental Health, Retardation and Hospitals and a representative from the Office of the Attorney General several months ago to discuss the feasibility of turning this property over to a local organization to rehabilitate the property for housing.
At that time the Council was informed that the plans were set for a residential drug treatment program facility for women, and that this was final.
The Council is in receipt of a letter from Gerald J. Coyne, Deputy Attorney General outlining the development of this property. This seems to be in conflict from what the Council was told several months ago.
The Council is asking for the following information:
1. When will a final decision be made for the property at 278 High Street in Pawtucket?
2. If the property is not used for a substance abuse rehabilitation treatment program facility for women, will there be a consideration given for local groups originally interested in acquiring this property?
The Council has major concerns regarding this boarded up building, as it is a target for vandals.
