City Council, April 25, 2001
A regular session of the Pawtucket City Council is held Wednesday, April 25, 2001, at eight o’clock p.m., in the City Council Chambers, City Hall, 137 Roosevelt Avenue, Pawtucket, RI.
Present – President Barry, Councilors Bray, Carr, Clemente, Grebien, Hodge, Moran, and Wildenhain.
Absent – Councilor Hoyas.
President Barry presides.

The Council is requesting that the necessary steps be taken to expedite the process of advertising for bids.

STIPULATION PER ZONING 3/27/01 –
1. Open storage of motor vehicles, auto parts, or debris shall not be visible from Prospect Street or the front of the building.
Speaking in favor is Monica Horan, Attorney representing the applicant, Antonio Albuquerque, 101 Riverside Avenue, Pawtucket.
Attorney Horan states that Mr. Albuquerque owns two separate businesses on Prospect Street. His plan is to consolidate all businesses under one roof. Mr. Albuquerque has been in business for ten years and has had no problems.
Mr. Albuquerque states that he has no problem with the stipulation placed by Zoning. He also states that he will be closing the Auto Repair business across the street on May 14, 2001.
Upon questioning from President Barry, Mr. Albuquerque states that he will be renting out the property across the street; however it will be for a non-automotive business.
Councilor Hodge questions if the stipulation from zoning relating to outside vehicle storage will affect the auto sales aspect of the business.
Attorney Horan states that she will bring the issue of outside vehicle storage before the Zoning Board for clarification.

Upon questioning from Councilor Bray, Mr. Pinto states that he will be operating out of the two garages at the end of the building. Mr. Pinto will be doing truck repairs on Monday through Saturday from 8:00 a.m. until 4:00 p.m., and he is planning on hiring one person.
Mr. Pinto states that he has lost his job and would like to open his own business. He will not be selling any used vehicles.

The Clerk is instructed to send a communication to Margaret M. Lynch, City Solicitor, regarding the claim of Maurice L. Caron, Sr. & Dorothy D. Caron in the amount of $500,000.
The Council is requesting the Ms. Lynch investigate with the Zoning Department to see if the “Group Home” at 363 Daggett Avenue is non-operational per the cease and desist order issued September 27, 2000.
If the owners are out of compliance, the Council is requesting that appropriate action must be taken to insure that the court order is fully complied with.
A response is requested in time for the May 9, 2001, Council meeting.

347.20 REFUSE DUMPING FEES.
The following fees shall be charged for the dumping of refuse at the Transfer Station:
A. $1.00 Annually for automobiles only.
A. $2.00 Annually for Station wagons, vans and pickup trucks.
1. These vehicles will be weighed and charged by the ton, per visit, at the residential rate
B. $5.00 Annually for all Commercial trucks.
1. These vehicles will be weighed and charged by the ton, per visit, at the commercial rate.
C. All other vehicles will be charged at the commercial rate.
D. All vehicles shall be subject to the sticker requirements as outlined in section 347.21.
347.21 IDENTIFICATION STICKERS.
All vehicles must obtain an identification sticker before dumping at the Transfer Station. The sticker shall be valid for one (1) year commencing July 1 through June 30 of the following year and is obtainable through the Public Works Office.
The annual stickers shall be issued as follows:
A. Blue sticker – $1.00 - automobiles must be registered on Pawtucket tax rolls.
B. Red Sticker - $2.00 – Station wagons, vans and pickup trucks registered on Pawtucket tax rolls.
C. Green Sticker - $5.00 – Commercial trucks.
