City Council, February 5, 1997.
A regular session of the City Council is held Wednesday, February 5, 1997, at eight o=clock p.m. All the members are present except Councilors Hodge and Rabbitt and President Barry presides.
The reading of the records of January 22, 1997, is dispensed with and the records are approved as prepared by the Clerk.
Upon Motion made by Councilor Vieira, seconded by Councilor Butler, the *consent agenda is approved on a unanimous voice vote.

The Clerk is instructed to send a communication to Jack Gannon, City Solicitor; Michael Cassidy, Director of Planning and Redevelopment, and Ronald Travers, Director of Zoning and Code Enforcement, requesting that they have a Acease and desist@ order drawn up and delivered regarding the construction of two houses at the corner of Terrace Avenue and Smithfield Avenue.
Councilor Vieira stated that there was confusion about the history of ownership about that property, which may have caused the Planning Commission to allow this construction which should not have been approved.

With majority consent of the Council, the following motion made by Councilor Vieira, seconded by Councilor Butler, is PASSED on a unanimous voice vote:
The Clerk is instructed to send a communication to Jack Gannon, City Solicitor; Michael Cassidy, Director of Planning and Redevelopment, and the Planning Commission, requesting that they investigate the approval of construction of two houses at the corner of Terrace Avenue and Smithfield Avenue, and what was the process used to make the decision. Specifically, the Council wants to know how they determined ownership of that property back to 1996, and whether it was actually investigated by the city.

Also, a motion was made by Councilor Cute requesting that Mr. Mangiante attend a pre-council session of the City Council on Wednesday, February 19, 1997, to discuss why people requesting information, particularly Leo Fox and Peat Marwick, have not been able to get information they need from the city.
