A regular session of the City Council is held Wednesday, March 20, 1996, at eight one o’clock p.m. All the members are present except Councilor Vieira and President Barry presides.
The reading of the records of March 6, 1995, is dispensed with and the records are approved as prepared by the Clerk.

The Clerk is instructed to send a communication to James V. Curry, Consumers Services Engineer, Eastern Utilities, Blackstone Valley Electric Company, regarding the street lighting conversion in Pawtucket.
The Council wants all lights in the city to be the semi-cutoff lights, including those which have already been converted to the fully cutoff lights. It is their understanding that there would be no additional charge for converting either the old style lights or the new cutoff lights to the semi-cutoff lights, and it is not their intention to pay any additional money for the replacement of the cutoff lights.

THE FOLLOWING ORDINANCE WITH PROPOSED AMENDMENTS IS REFERRED BACK TO THE ORDINANCE COMMITTEE ON A UNANIMOUS VOICE VOTE.
ORDINANCE IN AMENDMENT OF CHAPTER 2233 ENTITLED "AN ORDINANCE CREATING A CITY PENSION BOARD."
The entire ordinance shall be replaced with the following:
SECTION 1. Chapter 2233, entitled "An Ordinance Creating a City Pension Board" shall be amended as follows:
SECTION 1. shall be amended to read as follows:
There shall be in the city a pension board charged with the general responsibility for the administration and operation of all, city employee pension, disability pension, and retirement plans implemented by the city, including managing, vesting and overseeing all pension and retirement plans and funds to the extent allowed by law, to serve as a citizen’s watchdog group to insure that the investments utilized to secure the future fiscal viability of the pensions are sound, prudential and conservative and to otherwise insure that said pensions funds remain actuarial sound and stabilized as called for by the city charter.
SECTION 2. shall be amended to read as follows:
The pension board shall consist of nine (9) members, at all times the members of said Board shall include two (2) police officers and two (2) firefighters, the Director of Finance, the Chairman of the City Council Finance Committee, and the remaining members shall represent the general public. The representatives for the police and fire department shall be appointed by their respective members. The mayor shall appoint two (2) members from the general public and the City Council shall appoint one (1) member from the general public. In the event that a member is not present or recuses himself or herself from participation in any matter, the mayor shall be allowed to appoint and alternate member to participate in those matters. Said alternate members’ appointment is subject to council approval.
All members except for the Finance Director and the Chairman of the City Council Finance Committee shall be appointed for terms of two (2) years except for the seven (7) members originally appointed, three (3) of which shall be appointed for a term of one (1) year and four (4) of which shall be appointed for a term of two (2) years. Said terms commence on the first Monday in January of each successive year. The Finance Director and the Chairman of the City Council Finance Committee shall serve as members for the duration of their respective positions.
Section 5. shall be amended to read as follows:
The pension board shall be authorized to promulgate and establish its owns rules and regulations in order to fulfill its duties and obligations as set forth in Sec. 2-57.6, including, but not limited to, rules and regulations concerning determinations as to the maintenance or continuance of pension benefits subject to the limitations of law. Any rules and regulations or amendments thereto shall be submitted to the City Council for approval prior to their implementation.
Section 2. his ordinance shall take effect upon final passage.
THE CHAIR RECOGNIZES COUNCILOR DOYLE.

The Clerk is instructed to send a communication to the Municipal Police Academy, C.C.R.I., Flanagan Campus, to extend an invitation for them to appear before the City Council on Wednesday, April 10, 1996, to discuss the city’s decision to send three trainees to the Providence Police Academy instead of the Municipal Academy.
THE ORDINANCE COMMITTEE RETURNS THE FOLLOWING ORDINANCE WITH A RECOMMENDATION FOR APPROVAL WITH THE FOLLOWING AMENDMENTS:
Sections 4(a), 5, 6, and 14 shall be replaced with the following:
SECTION 4. Notice to Remove. (a) Whenever it comes to the attention of the Police Department or the Division of Zoning and Code Enforcement that any nuisance as defined in Section 2 of this Ordinance exists on private property in the City of Pawtucket, a notice in writing shall be served upon the owner of the land where the nuisance exists, and upon the vehicle’s owner or last known owner, notifying them of the existence of the nuisance and requesting its removal within seven (7) days. It shall constitute sufficient notice, when a copy of the same is posted in a conspicuous place upon the private property on which the vehicle is located and duplicate copies are sent by certified mail to the owner of the vehicle if known or the owner of the property at his/her last known address. In addition, the Police Department or the Department of Zoning and Code Enforcement shall post or attach to the vehicle, at least forty-eight (48) hours before towing, a notification of an abandoned or junked vehicle indicating that the vehicle will be towed. The Police Department shall be responsible for identifying the owner or last known owner of the vehicle.
SECTION 5. Content of Notice. The notice to remove shall contain the request for removal within the time specified in Section 3 of this Ordinance. The notice shall also set forth the consequences and effect of failure to reclaim an abandoned or junked motor vehicle and shall further state that if the abandoned or junked motor vehicle is not removed within the time specified, the City or its designee shall undertake such removal with the cost of removal to be levied against the owner of the vehicle if known, or if unknown the owner of the private property.
SECTION 6. Responsibility for Removal. Upon proper notice and opportunity to be heard, the owner of an abandoned or junked motor vehicle and the owner of the private property on which the same is located, either or all of them, shall be responsible for its removal. In the event of removal and disposition by the City, the owner of the vehicle and owner of the private property where same is located, shall be liable for the expenses incurred.
SECTION 14. Liability of VehicleOwner or Property Owner. Upon the failure of the owner of the private property on which abandoned or junked motor vehicles have been removed by the City, to pay for such removal, and if the owner of the vehicle is also the owner of the abandoned or junked motor vehicle, a lien shall be placed upon the private property in the amount of such expenses.

The Clerk is instructed to send a communication to Michael Burns, Traffic Engineer, requesting an opinion on placing a four-way stop sign at the intersection of Courtney Avenue and Manton Street.
The Council would also like a check on the number of accidents which have occurred at that intersection over the last year.
